A Takoma Park, Md., couple, turned in by their teen-age daughter for growing marijuana in their basement, will have their convictions stricken from court records, a Montgomery County judge has ordered. Katherine Marie "Kitty" Tucker and her husband, Robert Jason Alvarez, were sentenced in December to six months' probation and ordered by Circuit Court Judge DeLawrence Beard to pay a $150 fine.
But on Tuesday, Beard granted the couple's motion for "probation before judgment," a legal term meaning they will have no criminal record if they comply with the terms of their probation. Previously, Beard had denied that motion, and it remained unclear Thursday why he reversed that decision. The judge was unavailable for comment Thursday. Kitty Tucker said she believes the judge was influenced by the fact that she and her husband have completed their probation without any additional incidents. In August, the couple's 16-year-old daughter, Kerry Tucker, told authorities that her parents were growing marijuana in the basement of their home. Kitty Tucker's attorneys have said she used the marijuana to relieve severe migraine headaches and fibromyalgia, a chronic disorder that causes muscle pain. Alvarez, 54, was fired from his post as a senior adviser at the Department of Energy as a result of his arrest. poor little kid
she will probably lose many of the appurtances of the upper, upper middle class life to which she has become accustommed; now that daddy lost that cush job. such as the '99 jetta, the country club membership, the 2 week vacations to wherever. and the resultant loss in social prestige, certainly devestating. hope she doesn't end up selling rocks on the street. poor little lately rich girl.

To Jones
I appreciate the anger and frustration you feel with regard to how we are oppressed and the idea of a sixteen year old girl turning in her parents does tick us off. But please try to avoid using that kind of language on this site. Cannabisnews needs to be a forum where politicians, activists and parents alike can come and share their opinions(and check in to see what the other side is up to). It's possible some straight-edged people come through here and a comment like that could reinforce the stereotype we're working so hard to shed.thanks,arcturusFoM--Forgive me if I overstepped my bounds.

The real reason behind DARE
In the Soviet Union of the 1930's, the NKVD, predecessor to the KGB used to go around to the schools there and tell children to be on the watch for and report 'counter-revolutionary tendencies' to the authorities. This of course made them little spies. One such kid was named Pavel Morozov. He ratted on his parents, who were promptly locked up in the Gulag and died there. The kid's life wasn't much fun after that, and he hanged himself, despite having been proclaimed to be a Hero of the Soviet Union. This girl apparently had had an argument with her parents; they probably wouldn't let her stay out late or something equally petty. In spiteful revenge, she took a baggy of the MMJ the mother was using to fight various nervous illnesses and told the nice DARE cops where to find it. The parents were arrested, the father lost his job, the mother suffered without, and the kid almost got sent to a juvenile institution. DARE's only real purpose is intelligence gathering. No different than that of the NKVD/KGB did. Intell gathering on our own citizens. Something even the CIA is supposed to not do ( but of course, they do it all the time, by receiving info from their Allied 'friends'.).So, rememeber: the next time you may be critical of the DrugWar, keep in mind little Johnnie and Suzy just might be fresh from their DARE indoctrination - and listening to every word so they can report back to the nice policeman your thoughts on his or her efforts. And get you sized up for a drug raid.

I am glad they do not have to do time, but you are absolutely correct, if they were black or poor and had to utilize a public defender, then so sorry but.................
