William Michael Hervey, who'd been a referee in the 289th District Court since May 1990, resigned to Judge Carmen Kelsey. Hervey had been conducting juvenile detention hearings for Kelsey. "He called me and he said: 'I have bad news. I've been arrested for possession of cocaine. I've tendered my resignation effective immediately,' " Kelsey said Monday. Hervey couldn't be reached for comment. Court records show he was arrested Saturday and charged with possession of less than 1 gram of a controlled substance. The crime is a felony punishable by a jail term of 180 days to two years and a fine of up to $10,000. Hervey was released from Bexar County Jail on Sunday after posting a $5,000 bond. "I've been caught off guard, and am completely shocked and surprised," said Kelsey, who accepted the resignation. "It's very unfortunate, but (in resigning) he did the right thing." Kelsey said Hervey was appointed to the post of juvenile referee in May 1990 by former 289th District Court Judge Tom Rickhoff. Hervey conducted detention hearings one day a week, and was paid $150 for about an hour's work, she said. A juvenile referee may see 15 to 25 children a day, Kelsey said. The 289th District Court can have as many as six juvenile referees. "My experience with (Hervey) was he had always been appropriate and doing a decent job," Kelsey said. Hervey has a legal practice in San Antonio. He was a section chief in the Bexar County District Attorney's Office from 1980 to 1986, according to county records.
