Butte-Silver Bow leaders have discussed the issue informally, but have no immediate plans to limit caregivers, said council Chairman Dave Palmer. Commissioner Mike Sheehy said he's reviewed the Montana Medical Marijuana Act, and that he sees no need for local leaders to intervene in the issue.Sheehy agreed there's been an influx in caregivers in the city-county - nine have filed for business licenses - but he believes it's only a matter of time before patients "weed out" the providers who aren't legitimate.He sees the recent boom of providers as a short-lived phenomenon and doesn't see a need for government involvement."They are going to have to supply a good product. The guys who don't will be gone and the patients will take their card to another shop," Sheehy said. "The best will survive and the other guys will go under. That's the bottom line with it."But not all local leaders around the state have been willing to take the wait-and-see approach.The matter has been a hot-button issue throughout the state in recent months and, most locally, Anaconda-Deer Lodge County commissioners recently approved a six-month moratorium on medical marijuana caregivers in the county.The ordinance, which passed on a 4-1 vote, prohibits establishments that cultivate, manufacture and dispense medical marijuana, yet those with medical marijuana prescriptions may continue to use the drug.Anaconda has five registered caregivers.Anaconda leader said they wanted the moratorium to give themselves time to address zoning and public health concerns.In Butte, however, local officials think laws already on the books address many concerns.County Attorney Eileen Joyce said caregivers in the city-county would fall under the same restrictions as other businesses selling items and must operate within zoning laws.Planning director Jon Sesso recently denied a home occupation permit for someone hoping to sell medical marijuana in a residential area, and that person hasn't appealed the decision to the zoning board as allowed under local law.With commercial business sales already limited under existing laws, Joyce said no other proposals to limit the sale of medical marijuana are proposed.Other municipalities are reviewing possible new rules and regulations for the sale of medical marijuana, which Butte-Silver Bow is monitoring, she said."I think right now from our standpoint we are keeping an eye on what's happening in other communities and looking at what rules the (Montana) Department of Health and Human Services might implement," Joyce said.Butte also will keep tabs on the issue during the next legislative issue.
