USA -- When President Obama nominated Michele Leonhart to head the Drug Enforcement Administration last month, those hoping for a sensible federal policy regarding medical marijuana -- one that promotes scientific research into its medicinal value and eschews prosecution when it is used in accordance with local laws -- shivered. As special agent in charge of the Los Angeles Field Division, Leonhart zealously cracked down on dispensaries (though, it could be argued, that was during the Clinton and Bush years, and she was adhering to White House policy). Then, in 2008, as acting head of the DEA, she denied the application of a University of Massachusetts botanist to cultivate marijuana for research purposes (though that too was in line with the Bush administration's anti-science stance).
So what are we to expect now if she is confirmed by the Senate? Hard to say. Since Obama's swearing in, it has been unclear whether the DEA -- which Leonhart has been running as acting administrator since November 2007 -- is willing to abide by his administration's verbal and written policy of not pursuing medical marijuana operations that do not violate their state's laws.On Obama's second day in office, the agency raided a dispensary in South Lake Tahoe. Two weeks later, five clubs in Los Angeles were raided, prompting a rebuke from the White House. A few days later, the DEA raided a club in Fort Bragg, Calif. That prompted a speech from U.S. Atty. Gen. Eric H. Holder Jr. suggesting that federal resources shouldn't be focused on medical marijuana. In August, the agency raided more California clubs, and on Sept. 9, it moved against 20 in San Diego. Finally, in October, Holder put his directive in writing.Nevertheless, last week the DEA in Denver raided a grower after he -- rather imprudently, it must be said -- went on TV to discuss his basement operation. In a jailhouse interview with local media, Chris Bartkowicz, who has a state license, defended his operation and said he believed federal agents would not target it after the Holder order. After initially replying that marijuana is illegal and that they will raid whomever they please, the Denver agents now say Bartkowicz has more plants than state law permits. He says he doesn't. A judge will decide. The confusion can be resolved only by Washington. Fourteen states currently have medical marijuana laws, and more are likely to adopt them, multiplying the legal disarray exponentially. Ideally, a coherent policy would flow from the director of the DEA and out to regional offices. But that may not be possible; it's not entirely clear that Leonhart ever received Holder's memo.Source: Los Angeles Times (CA)Published: February 22, 2010Copyright: 2010 Los Angeles TimesContact: letters latimes.comWebsite: http://www.latimes.com/URL: http://drugsense.org/url/V7OTsWHeCannabisNews Medical Marijuana Archiveshttp://cannabisnews.com/news/list/medical.shtml

Afterburner ~ Neil Young
 I wanted to mention we are watching the Olympics and they said Neil Young will be in the closing ceremonies. I am so happy. The closing ceremonies will be the most people that Neil has ever sang for. What a tribute to Canada and a blessing for those who don't even know who he is.

I just checked out the Rust List and someone took this picture that appears to be Neil Young practicing in Vancouver. Now I am reading that Neil might be in the closing ceremonies in Vancouver on Sunday. That would be so cool. I have totally enjoyed the Olympics and the young Canadian who lost her mother on Sunday and won the Bronze last night was an amazing achievement under the worst possible circumstances. I love when they play your National Anthem. It's beautiful.http://twitpic.com/15e34g

That doesn't sound good about your furnace motor. This winter as far as I can remember in the 30 years we've lived here has been the worst as far as snow goes. Glad you liked my robin story. When we lost power for a couple of days a while back I minded it because I still wasn't feeling very well after my surgery and we had to melt snow for water since we didn't have any water saved. Now we are keeping water jugs filled. It's snowing again today. Stay safe.

We've had a light winter, so far. We didn't lose power this time (although we had a cold weekend previously waiting for a new furnace motor.) The recent storm just made driving more difficult. I had to deliver 2 hours longer than scheduled without relief (nobody else could make it in due to the weather delays). That was funny about the robin photo.

I hope you made it thru the storm without losing power. This has been a snowy winter down here. It's snowing again now. I'll probably take out the camera and take a picture of the first robin I see and frame it! LOL!People that say that this winter shows global warming isn't happening should look at the Olympics. Men were watching the bobsledding event with no shirts on yesterday!

DA Wasn't Kidding About Pot Clinic Crackdown
Making good on a promise, the DA prosecutes a popular medical marijuana dispensary operator.By Jonathan LloydFebruary 23, 2010Steve Cooley warned us this would happen. Back in October, the LA County District Attorney said state law doesn't allow medical marijuana dispensaries to sell pot over the counter. He vowed to target any pot clinics engaging in over-the-counter sales. On Monday, the DA's office charged the operator of a popular Culver City-area dispensary with 24 felonies. Bail was set at $520,000 for Organica's Jeff Joseph. He was charged with selling, transporting and possessing marijuana. Joseph pleaded not guilty. The bail amount is what gets Joseph's attorney. Attorney Eric Shevin called the bail "outrageous" and said the case was "politically driven," according to the LA Times.Cooley has announced he is considering a run for attorney general."So they use a very high-profile individual, unfortunately in this case, Mr. Joseph, to basically stand up for everybody," Shevin told the Times. The DA's office said that's not the case."There have been dozens of cases that the office has filed," Joseph Esposito, of the DA's office, told the Times. "We're going to evaluate every case differently."Cooley and City Attorney Carmen Trutanich have a lot in common on the issue. Last week, Joseph was taken into LAPD custody after a raid -- the third at the dispensary.Joseph closed after the second raid, but reopened.Trutanich has filed lawsuits against Organica, an Eagle Rock facility and two South LA locations.Prosecutors claimed in court that Organica sometimes turned monthly profits of $100,000. Joseph was called an "ongoing threat to the community," according to the Times' report.Copyright: 2010 NBC Universal, Inc.URL: http://www.nbclosangeles.com/news/local-beat/He-Wasnt-Kidding-85093272.html

To all my friends and countrymen at arms;
You kindness and enthusiasm for the advancement of freedom overwhelms me!The memories and lessons we have learned from this struggle will last us our whole lives. The friendships that have blossomed between complete strangers thousands of miles distant from one another is a miracle we are witnessing in our lifetime. Who would have ever known, before the Internet, that so many would come together into a new neighborhood of ideas and information such as this one? a Neighborhood where hearts and minds meet without the presence of a body. It sounds the same as meeting over in the spirit world where we are judged only on what we are in our hearts and souls. So tomorrow is another day, I will write, talk and live our message until we are satisfied that we are in control!Peace, love and may the spirit of Crazy Horse live on.Tonka Hey!

It's so good. We'll all be rejoicing over this for a long time.I'm so glad... so thankful. My hope and great desire and prayer exactly, including the good judge's complete release in a month, although I'd crazily hoped for such a thing, somehow, to happen today, too. Even though I knew it was practically crazy to hope such a wild thing, I hoped and prayed it anyway. I've so dreaded today... and it's turned out to be such a very, very happy day. I'm so grateful.I just can't stop being amazed and grateful. It's so wonderful. I'm so thankful.

Yea, verily, RunRuff, I say unto thee "Hallelujah!" This may be the start of something big, a "Revolt of the Judges". A great many of them are sick and tired of drug cases clogging their courts with no end of them in sight. Drug courts are just another relief valve hastily welded onto a boiler about to blow. They've got bigger fish to fry, but are forced to give priority to penny-ante drug cases. For decades they were told to 'shut up and soldier', to 'suck it up'. But now with the economy, mandatory minimums are just no longer economically feasible (as if they ever really were) and it's becoming clear we cannot afford to pay for the apparatus of the DrugWar, itself. Which gives these judges a chance to use the money card as well. This could get real interesting.

I said that is right but I never thought I would have a chance to discuss mmj in a federal court with a federal judge? I wouldn't be here except that I was told by the attorney that I could use in compliance with the law. In my state if I have a conviction for a felony Marijuana charge I can still qualify for a card. Clear and unambiguous compliance, I told him. He said that my PO charges that I signed an agreement to not use any federally banned substance, I see you have turned in eight positives for thc in the pase six months.I said what does federally banned mean when the attorney general says keep state laws and I do.The judge said clearly the law is to ambigous to enforce. He told the PA to look into federal precedence on this matter and for me to return to his court in 30 days and he will offically sanction my release. He would like to see Mr. Sisson return to his life, we have bothered him enough over this!

that our issue just isn't important enough for busy legislators to deal with.If it's not that "Important", why don't they just stop making it a crime. Whoosh! Done! It's "Not important" anyway... so why keep arresting and persecuting people and devoting endless financial resources to it? I do think arresting and threatening and persecuting people is extremely important. It's so important! Only sheer ignorance keeps them from seeing that.Oh... ruining people's lives over use of a plant. Not important? Their ignorance of "What is important", is staggering.

runruff, you would be shocked if you knew
How many of us are with you 100%...there are several here whom will do what they can to help, a little better than last time as we got a little more ammo now and a lot more supporters. I have said many a prayer over this and will keep you in my thoughts, you are not alone and this game they are playing with you will end eventually...it just may be the straw that breaks the camels back. There will be quite a few people whom are with you in spirit and one of these days all the evil deeds of these lying, cheating pigs will be laid open for all to see and people like me and you will have our vindication and it will be our turn...it keeps me going whenever the hate and sense of loss becomes too much to bear! May you receive justice and peace, Steve

Michele Leonheart!
Why doesn't Obama just install one of the "Boys From Brazil" and be done with it!This is the worst of all possible slaps in the face, from this man, to the the millions who supported him for this issue!I now see, like the past 40 years of lying and twisting in the wind, cannabis prohibition is more than a sacred cow to the feds, it the whole religon!
