San Francisco, CA -- State Atty. Gen. Jerry Brown says he will challenge a recent appellate court decision that struck down California's guidelines on medical marijuana possession and cultivation, leaving patients and police wondering how much weed is too much.Brown said in an interview this week that he would ask the California Supreme Court to overturn last month's decision by the state Court of Appeal in Los Angeles because it inhibits authorities' ability to control abuses while protecting legitimate access to cannabis.
The court ruled that the Legislature in 2003 made an unconstitutional amendment to the 1996 voter-approved Compassionate Use Act by specifying the amount of marijuana that patients could possess for medicinal purposes.The decision, hailed by some medical marijuana advocates, has not only cast doubt on the legislation’s standard of 8 ounces of dried pot and six mature or 12 immature plants. It has also created a cloud of uncertainty over more liberal guidelines adopted by some counties, particularly those in the marijuana belt of the North Coast.Brown, who supports medical marijuana, said the legislation was a reasonable approach to implementing a vaguely written ballot measure."The proposition is not as clear as we would like," he said. "You do not need an unlimited quantity of marijuana for medicine. But what is the quantity?"The marijuana initiative was designed to provide access to patients with cancer, AIDS and other ailments. But its execution has created a hodgepodge of local marijuana controls.In some locales, indoor and outdoor marijuana cultivation has aroused community backlash over the effect on neighborhoods, public safety and the environment.Law enforcement officials have alleged that drug dealers are hiding behind the marijuana law. And medical marijuana advocates are worried that abuses by some are threatening the access of deserving people to a medicine.The court decision, in late May, involved Patrick K. Kelly of Lakewood, who suffers from hepatitis C, back pains and cirrhosis. Kelly had a doctor's recommendation to use marijuana.But a search of his home in 2005 yielded some marijuana plants and 12 ounces of dried pot. He was convicted of marijuana possession and cultivation after a prosecutor argued that he had more than the 8 ounces allowed under the state guidelines without a doctor's recommendation for more. His sentence: three years' probation and two days in jail.In ordering a retrial, the appellate court found that legislation imposing a "cap" on the amount of marijuana was illegal because amendments to initiatives can be adopted only through a vote of the people.Some marijuana advocates greeted the ruling as welcome relief from any limits.Others and the attorney general's office said the appellate judges misconstrued the legislation because it contains no firm caps.They said the legislation set the six-plant threshold but allowed local governments or a patient's personal physician to set higher limits.Authorities and several advocates said that without rules on quantity, police officers must figure out on their own how much medical marijuana is reasonable.Kris Hermes of Americans for Safe Access, a patients group, said the absence of guidelines could prove "detrimental in the long run. . . . It's all left up to the discretion of the police and courts, and that is not good."Modesto Police Chief Roy Wasden, a member of the California Police Chiefs Assn. board, said it would be a balancing act."Obviously, someone with 100 pounds probably would not be viewed as having a reasonable amount," he said. "And probably someone with a few ounces would."California Narcotic Officers Assn. lobbyist John Lovell likened the situation to a return to the Wild West.When the appellate decision came down, the attorney general's office was close to issuing guidelines on medical marijuana for police who are concerned about criminal growing and dispensing, and for marijuana advocates who don't want narcotics officers breaking down their doors."We are trying to give guidance to patients as to how they can lawfully cultivate, acquire and possess," said Special Assistant Atty. Gen. Jacob Appelsmith. "And for law enforcement, we are trying to give them guidance."In Humboldt County, where the growing guidelines are 100 square feet of leaf canopy and as many as 99 plants, Dist. Atty. Paul Gallegos said of the court ruling: "It changes everything. It . . . means no legal limitations."The conundrum comes as another pot-tolerant county grapples with a revolt over its limits. A measure that was on Tuesday's ballot in Mendocino County would roll back a 25-plant cap that applied to recreational pot as well as medical marijuana.With thousands of votes still to be counted Thursday, the repeal effort was ahead 52% to 48%.Thirteen states have legalized medical marijuana, although the federal government does not recognize such laws. The way I look at it is that it is heavily monitor for thin ice. It is dangerous but truck driving on big 6 or more lane highways is dangerous too. The difference is if you mess up on the road you can kill other people even if it isn't the drivers fault. 80,000 pounds doesn't stop very easily. Being a contractor on a high rise building or a coal miner is very dangerous too. Having good common sense and a calm disposition is what keeps these guys going.

It's scary is why I don't like it....
Fantasy scary stuff, unless it's bloody nasty, is ok. The chance that a real person could suffer the fate of my nightmares is just too much. I don't find it entertaining. The people, the truckers, are great... the chances they take are too much for me.I also don't like Most Dangerous Catch. It makes me seasick. Got an update from CNN in email.

Trucks running over iced over deep water...
It is definitely crazy. One of my night terror themes is going out in a vehicle, usually at night, not driving, just a passenger, on a ice covered lake or large body of water and crashing through the ice into the black water. I'm sure that's full of dreadful dream meaning.... but I don't really care what it "meant" or signified, it was just terrifying. I don't like that show, probably because of those nightmares.When we got to the theater to see Indiana Jones... we had to sit near the front.... you couldn't even take the whole thing in without looking back and forth across the screen... but it was extra dramatic and exciting. Kind of like you were in it. I guess that's why kids like to sit close to the screen at movies.Yes, I would be a little concerned if I heard drums and chanting coming through the woods if I didn't know what was happening.

I never thought of that! LOL! They say life is slow in the country. I don't think so. I have plenty to fill my day. If we don't get to see it we will buy it when it comes out on DVD. This tv is so big it's like going to the movies. The surround sound picks up so many details. I just love it. I can sit over 20 feet away and still see it clearly. I do love modern technology. I'm watching the preview for the new season of Ice Road Truckers. Stick ice road trucks in Chicago in the winter but it isn't over water thank goodness and now on IRT it will be over the Arctic Ocean. That's crazy!

I agree with the article. I don't support the horse racing industry. Many a good race horse was remade into a English Hunter, Jumper or Dressage prospect. The one stable I was with bought horses from what we called the Killers. We saw the damage done. They are slaughter or sent to France for human consumption. The sport I was in was a sport. We didn't win money it was just for the fun and challenge of competition. When you take the money out it can be a very good experience.PS: I never drugged a horse unless it was hurt and needed drugs for pain and was taught it never should be done except in that circumstance. It's an ethical thing.

Gardening is fun. Everytime I plant a garden our neighbors cows get thru the fence and eat it. I run out with a broom and yell and jump up and down and the pretty cows keep munching and looking at me like I'm crazy! LOL! I gave up. The humidity was horrible today. We didn't go to the drive in tonight because our friend got stuck in Michigan and got home late and then they helped each other get the air conditioners in our houses. Finally it is cool. It has been unbearable. I know what you are going thru. This is the drive in we hopefully we get to go to next weekend. We only found out tonight that the Lake had a rock band and fireworks at the beach and they are having a two day Pow Wow and Indian Arts and Crafts over the hill from here. cooling down the front of the house. Which is alright because that's where the main bedrooms are anyways. But boy it sure is humid here today. I'm nearly sweating just from writing this comment.And I had no idea that they even had drive-in theaters anymore. That's awesome! And Indiana Jones would be the perfect movie to see outside on a nice night.I'm trying to grow strawberries myself for the first time. I only have four plants but I have to work with limited space here in the city. I had a couple of berries that were turning slightly red until they suddenly vanished. I'm guessing the birds got a hold of them. But I'll keep trying.I'm really beginning to love gardening though. Even if all the animals are having fun nibbling on my plants.

Off Topic: Ice Road Truckers
I really enjoyed Ice Road Truckers last year and the new season starts on Sunday night and this time they will be driving on the Artic Ocean. I don't think this was ever tried before. What we see in the trucking industry is very troubling. The only reason we will be able to hang on is because our truck is old and paid off. Our trailer is paid off too. The truck is in the garage with major maintenance work so Stick will get a break and since the weather is so hot it's a good time to be down. Our one friend is stuck in Michigan and the company saw how much fuel was being burnt up by idling and they told him to shut the truck off. It is very hot a humid where he is right now. A couple very big companies are in trouble and that's a bad sign. Fuel is costing $11.00 a gallon in Britain or some other country. I only saw a little of the news piece so I'm not sure what country.

I used to worry about ambulance and emergency services being able to locate people quickly out in the boonies... and now this fuel thing adds another aspect of concern.Fuel economy in a vehicle has always been important to us because of long commutes, so I haven't got a gas hog either, for which I'm very thankful.

Rain and Fuel Prices
It's great to see you Steve. I heard in rains a lot up in your area. This heat wave is the first of the season and it slows a person down. Hope, I think commuting to work from rural america or people who live in the suburbs will get very difficult. We go shopping with our friends and share the gas price. I'm glad we never bought into the idea of owning an SUV. When they became popular I just couldn't believe it. If we ever buy a new car again, which I doubt, it will have to get excellent gas mileage. Stick doesn't have to drive far to get to where he works and keeps his truck which helps.

What is this "air conditioning" you speak of?
Where we live here in Washington I don't think I know one person who even owns an A/C...which is so weird being from Ky where if you don't have A/c, you don't have much peace in the household nor sleep. We have been running the heater today though so I guess we use as much energy as back east...just in different ways. dang rain won't quit long enough here for it to ever get too hot.
 It's really kewl living in the small communities around Seattle as the people are worlds apart in mindset and seeing where the two cultures meet is like watching the holocline(where salt and fresh water meet) in cave diving...Strange days indeed.

Fuel prices
These prices are making it harder for people who live out in the country and have to commute a long way to work and buy groceries... as is often the case here in Texas. Of course, groceries are already showing the effects of the gas prices.This is probably going to cause more people to desert the rural areas, like they did after World War II. It's sad.

We are so far behind the times with so many things in my state. Health food stores are scattered and very small. The good thing is a family can build ( no real inspections ) or buy a home and it doesn't cost near as much as bigger states. The more you go out west from here the more progressive everything is it seems.

Agave is a natural sugar syrup made from the agave cactus. Agave is safe for diabetics. It is sweeter than sugar and has less calories and will not raise your glycemic index.The hemp milk is delicious. The ice cream is delicious and healthy.

You don't need air conditioning in San Francisco? Maybe it's because of the ocean that it is cooler. It really is humid and hot here today. Fuel will probably hit $8.00 a gallon before Bush is out of office I think. The fuel sur charges keep going up to help truckers with the impossible prices but it will be passed on to the consumers. These are going to be very hard times for people if they aren't ready for what is ahead I believe.

We have a small air conditioner for the bedroom and we put it in today so it will be ok to sleep tonight but the big one needs one of our friends to help muscle it around and that will be tomorrow. It's hot enough now at night to go to the Drive In and see Indiana Jones. We'll be able to sit outside the cars and enjoy the movie. A group of friends are going so it will be fun. If it storms tomorrow we'll try next week.Watch out for those storms. They really are bad.

All we would have to do if this precedent were upheld, is simply elect a pro-cannabis Sheriff. All politics are local.

I thought he used to be an ultra-liberal presidential candidate, sort of like the Kucinich of the late 70's and 80's.Then he got all "Mr. Tough Guy" on us when running for AG apparently.I hope this does come to ballot so the voters can approve a huge amount.

this IS the same guy. Pat Brown was his father,,and Jerry was mayor of Oakland,,while willie brown was mayor of SF,,no relation. He also dated Linda Rondstat for 5 minutes.

I don't know but I did a search and he is a Democrat but he is 70 now. He was born before the 60s revolution and probably didn't like it very much. Age does matter.

Since cannabis is a plant it can fall prey to bugs like Spider Mites and a patient could lose everyone one of their plants. Anything can go wrong with a natural substance so lifting quantity restrictions should be considered.

Malpractice I would say.Finally, if they must have some arbitrary quantities in order to feel powerful, how about the Federal Government's own standards? For decades the Feds have provided medical marijuana to a number of ill patients. It is well documented that for a least on eof the patients the quantity shipped is 3/4 of a pound per MONTH. That's 12 ounces.Mr Kelley, whom was arrested in the article above had 12 ounces. The federal program patients receive that each month!
In this increasingly difficult math, you arrive at 144 ounces per year by extrapolating the 12 ounce per month number. Delving further into the mind bending math you can determine that 144 ounces is 9 pounds.Now, consider you generally have one outdoor growing season per year, in which to amass those 9 pounds, which if successful will leave you with a 9 pound supply to carry you through to the end of the next growing season. Indoor growing you could have multiple growing seasons or a somewhat constant season. But indoors, as is well documented for anyone looking, a grower will only get 1, maybe 2 ounces per plant, which means you would have to harvest 12 plants per month to achieve a 12 oz per month quantity. You must also have a number of plants waiting in the wings for the next cycle, that's at least a 24 plant total. You would additionally have to have seedlings for the 3rd cycle. Now, consider only half of those plants will be the required female plants. So, double the numbers to account for that.Outdoors is another issue. Plants could provide 2 to 16 ounces outdoors. Again, heavy heavy math required. The difference is you will likely have only one harvest per year outdoors so, you must amass those 9 pounds in one harvest.
The plant count: from 9 to 72 plants.Hey, it has worked for the Feds and their patients for decades now so, how about guidelines based on those figures? If I can have 500 cartons of cigarettes and 100 gallons of beer in my garage, I should be able to have 500 pounds of pot if I want it. I can only smoke so much at a time anyway, what difference does it make? It's my.. personal.. business.

Now, if I get cancer or some heinous disfiguring injury, or maybe hurt real bad in Iraq during War, Jerry Brown, a aging political bureaucrat, gets to control how much pain-relieving medicine I "need". Even when the medicine is a plant that grows vigorously in my California garden. If I have even a few ounces more than Jerry says I need, armed thugs come to the house, break down the door and tackle me to the ground, taking me away in irons to jail.What a country!
