RALEIGH Certain types of pipes associated with marijuana smoking -- now legal in North Carolina -- could be outlawed as drug paraphernalia under a measure before a state House committee.
Kannapolis lawmaker Richard Moore ran across a such a pipe -- commonly called a bong -- in a skateboard and bicycle shop where he was browsing with a boy from his church. Moore wants the state to stop the sale of water pipes, which are marketed for tobacco products but often connected with marijuana smoking. “It is just ludicrous to believe that they are selling these items to anyone for tobacco purposes,’’ Moore said. “We send a mixed signal to our kids when we say ‘Don’t use drugs, but it’s OK to buy a bong.’’’Under current law, bongs and pipes are illegal only when police find traces of drugs in them or can otherwise link the devices to drugs. Moore wants to tack a provision onto a Senate bill that would make many types of pipes illegal to sell or possess. The measure would also ban roach clips, miniature spoons and vials. Wooden pipes and rolling papers would remain legal products. In addition to forbidding the sale of bongs, the law would make it illegal for anyone who now owns such a pipe to keep it.“It would certainly close a loophole in the law,’’ said Garner Police Chief Tom Moss.The idea sparked debate in a House judiciary committee on Tuesday over how to draw the line between drug paraphernalia and legitimate smoking products. Committee members want to hear from someone in the tobacco retail business. For now, the proposed amendment rests in a subcommittee.A 1994 Supreme Court decision allowed states and municipalities to make their own rulings on the products, and lawmakers have struggled at times to reconcile anti-drug efforts with smokers’ rights, said Allen St. Pierre, director of the NORML Foundation, a national marijunana law reform organization. The drug paraphernalia definition is often cloudy. “It’s a very, very gray area of the law,’’ St. Pierre said. Prohibiting such sales won’t curb drug use, some critics argue. And restrictions in other states have led people to smoke with homemade devices, increasing the odds of inhaling dangerous fume, St. Pierre said. “So, in essence, it will be a bittersweet law if it’s passed,’’ he said. ‘‘What’s going to stop them from smoking it out of a wooden pipe?’’ said Eleanore Queen, owner of Post Primitive, a tattoo and piercing shop on Yadkin Road that also sells pipes along with tobacco and herbal blends for smoking. “It’s about responsibility -- responsible people selling to responsible people,’’ Queen said.At Post Primitive, customers must be 18 to buy tobacco products, pipes and even the non-tobacco smoke blends. The store doesn’t sell to people who ask for crack pipes or marijuana bongs.The pipes offered there can be pricey and ornate. “They are not drug paraphernalia in our eyes,’’ Queen said. “For me, they are beautiful pieces; they are conversation pieces. We have people that buy them simply because it looks cool.’’But Moore said many retailers pay only glancing attention to their own rules. He told the House committee that he sent two legislative interns to a Raleigh shop. The intern who asked for a bong was turned away, but the clerk told the second intern that he was free to stay and purchase a water pipe for smoking tobacco.Moore pulled two glass pipes from a paper shopping bag during the committee hearing. One blue glass pipe stood more than a foot tall. The clear glass pipe was a few inches long with a bulbous head.While bongs are legal products, retailer Infinity’s End in Charlotte no longer sells them. “The correlation between bongs and drug paraphernalia is very long ingrained in people’s minds,’’ said Frank Pietras, president of the shop that is now in its 30th year. “We decided to sell less controversial pipes.’’

I think pot stinks smells bad and reaks, but I don't think making things illegal really do any good. Just make it more profitable for gangsters which, in turn, raises crime more. The Government has it planned out, they'll make more things illegal to increase more crime so they can get more funding to fight the increased crime caused by increased laws. Government already takes too much out on taxes to fight this stupid drug war, it isn't ever going to stop because it isn't anything that can be won. There really isn't a war, just a war imagined by the government to make some cash.
However, I still caution, don't do pot, it's not worth it.

I disagree about the quality falling. . . I think that quality would in fact increase. It'd be the whole supply and demand thing. . . producers would strive to grow the best bud possible so you'd buy from thier company and not Brand-X. Since it would be legalized, they'd have to up the quality since people could get it more places. If the only place you can get your bud is from a dealer, (Can't/Won't grow your own) you have to take whatever lame shit he's selling, you don't get a say, but if you can walk into the local revco and get a selection of commercial bud, you're going to get the best one. People couldn't afford to sell shitty herb because no one would buy from them. . .

My comments are for Kaspah's remark about wtf bud is illegal. I didnt think it was possible myself, but bud actually IS addictive to some people (a very very small percentage), and must be smoked daily for an addiction to spawn, not un-like cigarettes... and no, bud doesnt make you violent, or cause accidents, but have you ever seen someone who smokes bud daily (bud daily = .5/oz day+, not a joint or two a day) run out of bud for a day or two? They start being all bitchy and trying to figure out how they can get some more bud, more as a mental addiction than a physical one, not quite as bad, but close to the severity of a crackhead. Dont get me wrong, I smoke bud daily (.5oz - 1oz.) & constantly, and I am a strong supporter of legalizing, but i'm posting this message so people who (like i used to) think that bud isnt addictive will know what's coming down the road... Youre fine as long as you have bud, but once you run out is where the addiction kicks in. There are 3 types of people in the world. Those whom smoke bud, those who dont but dont mind other people smoking (x-smokers), & those who dont & never have, never will, & raise the biggest mess over who IS smoking bud. If that third type of person would shut the f*%# up and stop fighting against what they have no clue about, we'd have no problem getting bud legalized, but it's like the old saying, people fear what they know nothing about. The same sh*t is happening this year in the presidential election AGAIN, with the runners being questioned about PAST MARiJUANA use and the runners avoiding the questions... PEOPLE, GET A CLUE... BECAUSE SOMEONE SMOKES/HAS SMOKED BUD DOESNT MEAN THAT THEY ARE INCAPABLE OF DOING ANYTHING AT ALL THAT A SOBER PERSON CAN DO. In most cases, a bud-smoker can actually OUT-PERFORM a sober person due to outstandingly lower stress-levels, and an extremely higher tolerance to the bullsh*t that happens daily in normal life. The only drawback to having bud legalized would, in-fact be the government, once again. Right now bud is illegal and the government is the drawback because of their classification of bud as 'illegal'... if they were to legalize bud, guess how it'd work... they'd find a way to regulate it, meaning simply, directly or indirectly they'd be in charge of growing, they'd monitor/possibly alter genetics, monitor use, and eventually, you'd be hard-pressed to find decent bud anywhere... you'd have to grow yourself, secretly, or know someone who was to get even the quality of lousy bud today... and kindbud? hah. sure... theyre gonna sell something with that much thc legally... hydro? nope... doubt that seriously too... only good thing would be the price going down, but is even sh*ttier bud than most dealers have today actually worth the effort? Someone tell me when anything milestone happens... 'til then... i'll just keep with the routine that's lasted me the last 9 years & keep the kb coming & smoke reggie more than I smoke cigarettes...
