cannabisnews.com: Police Weigh Options in Pandora's Box Raid Police Weigh Options in Pandora's Box Raid Posted by CN Staff on April 15, 2003 at 10:02:57 PT By Doug Harlow, Staff Writer Source: Kennebec Journal Waterville — The question for police and prosecutors this week is not if there will be charges brought against the owners of specialty shop Pandora's Box on Main Street.The question is if the charges will be criminal under state law or civil, as they would be interpreted under a city ordinance prohibiting the sale of drug paraphernalia. "I want to consult with the chief and Detective (David) Caron and the other police officers involved in the investigation," District Attorney Evert N. Fowle said. "I want to have a meeting with them soon and see the evidence and strategize." He said a decision could be reached by the end of this week. Pandora's Box, based in Presque Isle, had been open less than two weeks at 109 Main St. when Waterville police raided the store last Thursday. Police Chief John Morris said officers seized anything that they thought had to do with drugs —pipes, bongs, signs, T-shirts. "Anything made for or advocating the consumption and ingestion of illegal drugs," he said. The store in Waterville and another in Presque Isle are owned by Joseph Correale of Fort Fairfield. Correale visited Waterville last week after the raid, but declined to be interviewed. Caron said police confiscated 250 pipes of various size and description, including a large brass hookah pipe, along with 50 postal scales, plastic "bongs," water pipes, pipe screens and detoxification liquids designed to flush a person's system of illegal drugs. They also seized T-shirts with pictures of marijuana leaves on them and stickers saying such things "Got Weed?" and "Stoner Chicks Rock". Police also found a special mask attached to a pipe bowl designed to cover the smoker's face and head for greater access to the smoke. Other items on sale at the shop such as leather jackets, incense and shelves of sex toys and erotic devices were not taken in the raid. The store was open Friday, a day after the raid, but was closed for business Monday. Morris and Caron said the proximity of about 250 smoking pipes to items clearly advocating the use of marijuana made the objects for sale in the store illegal drug paraphernalia. Fowle said the city ordinance forbidding the sale of such items has been on the books for 20 years. He said the merchandise for sale at Pandora's Box was not the same as the items that were being sold at Happy Trails, a boutique located just four doors down Main Street. Happy Trails was raided in September 1999. Police confiscated about $10,000 worth of merchandise, mostly pipes. A judge later ruled that police had not proven that the pipes were intended to be used to smoke illegal substances. The merchandise was returned to the owners, in effect setting a precedent that the items were not drug paraphernalia. Fowle said in the case of Pandora's Box, the pipes and bongs were for smoking marijuana and that he intends to prove it. They don't necessarily want to use their grandfather's pipe. There are much nicer small pipes available for that use today. I don't think anyone should smoke tobacco, but I personally know several who use these types of pipes for tobacco. Maybe if they hired a detective who paid attention in class...
