The Ontario Court of Appeal upheld a lower court decision Monday that allowed an epileptic man to smoke marijuana for the past three years. Terry Parker, 44, said marijuana has virtually alleviated the 15 to 80 seizures per week he suffered for 40 years as a symptom of his illness. Monday's decision will open doors across the country for sick Canadians who need the drug to help alleviate symptoms such as nausea and vomiting, said Aaron Harnett, Parker's lawyer.
In 1997, Justice Patrick Sheppard stayed charges of marijuana cultivation and possession against Parker, noting that his illness was best controlled by a combination of prescribed medication and smoking marijuana. Parker, who said he smokes up to four marijuana cigarettes a day, was able to discontinue all his anti-convulsant drugs this year. "It's insulting, it's barbaric," he said of the government's attempt to ban epilepsy-sufferers from smoking pot, an activity that Parker said has produced "a miracle" in his life.
