Agreement allows man's father to maintain residence if son refrains from using illegal drugs. The local prosecutor has agreed not to seize an elderly Augusta man's property if he ensures that his quadriplegic son will keep marijuana and friends off the premises.
In a consent order signed last month, Lewis Covar Sr. agreed to abide by the district attorney's terms in order to save the Fernwood Circle home he bought for his son Lewis Covar Jr., paralyzed from the neck down as a result of a July 4, 1967, diving accident.``I guess it's all taken care of now,'' the elder Mr. Covar said. ``No news is good news, they say.''District Attorney Danny Craig filed a forfeiture action to seize the $53,200 house last month, contending Mr. Covar's son used the home to facilitate the possession and sale of marijuana and Valium. The younger Mr. Covar, 51, who faces an April 17 trial in Richmond County Superior Court, was arrested Jan. 25 on a charge of possession of marijuana. It was his fourth felony-level marijuana arrest, and it led to the revocation of a seven-year probation sentence he was serving.Mr. Covar Jr. contends he smokes marijuana to ease painful muscle spasms, preferring it to physician-prescribed Valium, which he says leaves him mentally incapacitated.Since his imprisonment in February he has undergone four surgeries for the treatment of sores, Mr. Covar's father said.``He's such a mess now,'' said the 76-year-old man, who had taken care of his son's medical and personal needs until the son was sent to prison.Mr. Craig said he believes the consent agreement worked out with the father will solve his and the community's problems, allowing Mr. Covar to keep the house and prevent his son from using or dealing in illegal drugs.``At no time has owner, Lewis Edward Covar Sr., engaged in the distribution of marijuana or conspired to engage in the distribution of marijuana,'' the order signed by Judge Carl C. Brown Jr. reads. ``The court finds that unusual circumstances exist to invoke the equity jurisdiction of the court to prevent future use of the property to facilitate violations of the Georgia Controlled Substances Act ... and to recognize the lack of an alternative remedy by the owner, Lewis Edward Covar Sr.''Under the agreement, Mr. Covar's son can live in the house when freed from prison, so long as no one but immediate family members, emergency medical personnel, one care giver, maintenance personnel, cleaning staff or clergy enters the house. Anyone else must obtain Mr. Craig's written permission. The younger Mr. Covar is also barred from possessing marijuana or any drug not prescribed by a physician. The agreement also holds the elder Mr. Covar responsible for his son's behavior and makes it his responsibility to evict his son if the conditions of the agreement are violated.Reach Sandy Hodson at (706) 823-3226.Published: April, 8, 2000 ©copyright The Augusta Chronicle. Beating up on the helpless
Of all the truly sick things this country has done in the name of 'saving the Chil-druuun!' this is out and out madness. But it is indicative of something that even the antis are starting to tumble to. It doesn't look good when a healthy man beats up on someone who is crippled. Because it shows two things. First, the moral bankruptedness of those who pontificate against drugs (while swilling alcohol and puffing cigars) and second: their too-quick willingness to use force to gain their ends belies any supposed legitimacy they claimed. It evaporates in the face of their attacks(!) on those members of society least able to defend themselves from their predations. If items like this got round-the-clock exposure by the news media, this damnable DrugWar would be over in months. But too many people have a vested interest (courtesy in part to Barry-ola) in keeping stories like this out of the limelight.Shakespeare said: 'Oftimes the Law an ass'. It seems now more than ever, on the matter of this DrugWar, the man was frighteningly prescient. But I think Cicero said it best, over 2000 years ago: the Law is a whore that smiles at the man with the biggest purse. This, from one of the greatest lawyers who ever was. So he ought to have known, eh?

The Hypocracy of this Nation Astounds Me!
I have worked with quadriplegics for over 12 years off and on in the hospital. It can truly be an appaulling existence, being utterly helpless to help yourself to begin with, and then being surrounded by a country hell-bent on continuing the utter madness that is Marijuana Prohibition. Join MAP Inc., now that we know that it gets under the ONDCP and the "czar's" skin and wreak havoc on this putrid, decaying canker!

How wonderful
As if this is some kind, lenient, and benevolent humanitarian gesture....GOOD GRIEF!! First they throw this quadrapalegic guy in jail.(as if somehow he wasnt already in jail,,,I know, because I have several good friends who are 'quads')..As if he was somehow a threat to society. Then,as if locking up a QUADRAPLEGIC in some cell wasnt sick enough,,this D.A.,Danny Craig, somehow justifies the seizure of the house. This thing is in the Outer Limits. I'm sure public outrage played a part in this gracious act of kindness and lieniency. The ignorant and coldly brutal act of actually locking up a quadraplegic is a shocker.I guess this is how they keep the crime rate low,,, way down south there in Georgia...Southern justice..... These good ol' boys should try going a week,or even a day, without the use of their arms and legs. Then they would realize that jailbars are not that relavant to a quad.........Even after all this,This D.A. would probably say;"You're right, locking him up is not severe enough.".............dddd

Mayhem....
Taking medication away from quadriplegics is truly sick. The drug czar obviously has no conscience. I hope this father can get the money he needs to move to a place that allows his son MMJ, but it's a shame they have to go through this. I also hope that years from now, the procecuted will file a class action lawsuit to recoup their pain and suffering AT THE GOVERNMENT'S EXPENSE!
