California resident Angel Raich had tried dozens of prescription drugs, but could find nothing to control the pain resulting from her brain tumors. Frustrated, Raich turned to marijuana, legalized by the passage of California’s 1996 Compassionate Use Act allowing medicinal marijuana use. In 2002, however, federal agents raided the cannabis gardens of Raich and another sick woman, Diane Monson, claiming the possession and manufacture of marijuana violated the federal Controlled Substances Act.
The main question the courts have to decide regarding this case is, if the constitutional “Commerce Clause,” which gives congress the power “to regulate commerce with foreign nations, and among the several states…” can be used in this case to prevent the possession and manufacture of marijuana. Raich has already won the first battle in the Ninth Circuit Court based in San Francisco. The court believed that the Controlled Substance Act, in conjunction with the Commerce Clause, was designed to halt drug trafficking. Accordingly, in late 2003, the court ruled “the appellants’ class of activities - the intrastate, noncommercial cultivation, possession and use of marijuana for personal medical purposes on the advice of a physician - is, in fact, different in kind from drug trafficking” and “ the CSA is an unconstitutional exercise of Congress’ Commerce Clause authority.” There are larger issues at stake in this case, however. Also being debated is that a federal law can trump a state law or act passed by the voters of a certain state. Initially, the Commerce Clause severely limited the powers of the federal government to regulating international and interstate trade. On top of this, the 10th amendment delegating power to the states was used to block federal laws that conflicted with state laws (hence the reason a constitutional amendment was needed to implement prohibition). Over time, however, the Commerce Clause has been greatly expanded to encompass almost every transaction made in the United States. The advent of the telephone, and more recently, the internet, has led to an increased classification of commerce types as “interstate.” The stakes are high for both sides. Medicinal marijuana laws in eleven states could be jeopardized, while state laws in general could be jeopardized if they conflict with federal regulations. A loss for the federal government, on the other hand, could hinder federal oversight across the board. Along with illegal drug trafficking, the federal regulation of state industries and the environment may be hindered as well. The Bush administration has used the Controlled Substances Act before in an attempt to nullify state laws. For example, in 2002, Attorney General John Ashcroft attacked Oregon’s Death with Dignity Act – an act passed by voters allowing doctors to prescribe lethal pills to the terminally ill. Like the marijuana case, a US Circuit Court upheld Oregon’s law, and Ashcroft appealed to the Supreme Court, where the case currently waits. The ruling could have a profound impact in cities such as Ann Arbor – a historically liberal enclave which hosts the annual protestation of the War on Drugs known as “Hash Bash.” The city, which decriminalized marijuana in 1974, recently passed a measure legalizing marijuana for medicinal purposes. Ann Arbor’s situation also raises an ironic nuance of marijuana debate. While liberals are historically more accepting of lenient marijuana laws, conservatives generally support the right of states to enforce their own laws within their own borders without federal interference – a central issue at play in this case. These complexities make the ruling extremely hard to predict. Although the ruling will not be handed down until June, several justices have already voiced some thoughts on the case. Judges like Sandra Day O’Connor and Ruth Bader Ginsburg seem to side with Raich, noting that the growth of marijuana for strictly personal, medicinal use does not constitute “interstate commerce,” and therefore should not be regulated by the federal government. Those who have voiced concerns, including Justices Stephen Breyer and David Souter, seem to fear recreational marijuana users will attempt to hide behind the medicinal laws, creating mass confusion, and that the lack of prosecution will encourage illegal marijuana use among these recreational users. Unfortunately, a victory for the federal government will likely have the most profound impact on those who benefit the most from medicinal marijuana. While the Bush administration has seemingly decided that marijuana has no place in the field of medicine, they hold their beliefs in contrast to the nearly 100,000 Californians who use the drug to control pain. A “law-abiding citizen” – as Angel Raich’s attorney has described his client – is more likely to abide by the Supreme Court’s ruling than “recreational” marijuana users. In this age of global terrorism, the federal government can certainly find better things to do with its time and resources than raid the marijuana gardens of cancer patients. In a case that could deliver a serious blow to the concept of “states rights,” the Supreme Court should restrain the power of a regnant executive branch. Guys, about the computer
I wish I had checked with you all about the computer. Sometimes, I forget what a bunch of computer whizzes we have here. But, I didn't really go shopping for it. After I decided to not go the Mac route, I simply left it up to my husband. He was exhausted when he came in from work but he read what you guys wrote. He wishes he had known, too.The information is very muchly appreciated. Thank you all.Hard lesson learned.(Sorry about not answering in a timely manner. I knew there was something I needed to answer...but...I didn't get stoned...and I forgot where it was, anyway.)Thanks.:-)

Just now saw this post. A few mornings ago the internet wouldn't connect and I had mucho errands to run and chores to tend to. When I got back that evening, my husband had dibs on the puter so I crashed. I need my CannabisNews every morning just like that first cup of coffee and I miss it very much if I don't have it. The first thing I do every morning is turn on the computer, make coffee, and read CNews. Thanks.Don't trust anyone over 103 and keep on keepin on!

I waited to order the DW6000 modem until this new computer was here. I wanted to install the new computer with the new modem right from the start. I think this is really great. I haven't had to call tech support once. PS: We just got our Christmas Order today. We are watching Simon and Garfunkel's Old Friends DVD from their tour in 2003. It is really good and only cost $14.99. That's a lot better then $150 a ticket. This concert was the largest money making concert of the year. It also shows that " those potheads" can still do it all. How can anyone say Cannabis use hurts people? Lies Lies and more lies!PSS: I e-mailed you.

I really think that my satellite is what helps my computer to work so well. I can watch a video or DVD, surf, set up an article and probably more if I could do more at one time. I showed how quick it is to a person and he decided to get one too. I went thru a few things and he said I wouldn't even have the first thing loaded on my isp.I'll e-mail you.

Fast vs Speed
Most people don't need the absolute fastest machine out there unless planning monster gaming activites or large audiovisual file processing.I just moved up to a Duron Processor after wearing out an Amd K6-2... seems to be pretty fast still.I extol to all who will listen that the size of your pipe, ( bandwith :-) ), is more important than the fastest machine, to most of us ... it will even make a PII seem fast when surfing.I have a number of computers laying around and I keep a few running at any given time ... a different take on "backup. FOM, I am gonna be in Gilbertsville, KY this weekend, Sun-Mon. You anywhere near there?E mePeace all

That is something what CompUSA does. I know that Gateway and Dell are more expensive but we don't have any good computer repair services in our area. I can't afford to be down because of CNews. I had terrible problems with my first two computers but this is my 3rd Gateway and they have been really good if I needed help. Services when you live in no man's land is something that is really important since I don't know how to fix things myself.

If it happened to me, and they wouldn't cancel the contract, I would change the credit card just like if it were stolen. Then I would write up every detail of the situation in case AOL tried to press it later or sue or something dumb like that. Then I would have some fun sending threats to sue and bring bad publicity on them (newspaper stories, etc.).

Hi, your husband's first mistake was buying at Comp USA. They are well known to be the AOL of the retail market. That's why the scum hang around together. I wish he could have known first, sorry. Be sure to consult your friends at CNews before making big purchases.What happened is that that deal is a typical deal there, but your husband didn't notice that the AOL service was a required element of the deal on the PC (fine print basically). Unethically, the Comp USA salesman was keeping quiet, as he should make sure each customer understands that they are committing to a year of AOL when they buy these machines. When your husband bought the PC, he signed the contract. Again, that's underhanded of them because it should all be very clear at the time of purchase. If AOL let you out of the contract, you got out easy. I bet hundreds of people yearly make that mistake and call up AOL all pissed off and confused.

I'm appalled and don't really know what to do."If time is of the essence, why not try calling your Long Distance Carrier or your Local Carrier if it was an "800" number? Explain the reason for your call and ask for a printout of their log of your outgoing calls during the suspected period of time in which you think the call occurred. They log everything. If the customer service representative that answers your call does not understand what you mean or is uncooperative, ask to talk to their supervisor.Best of luck.

This computer came from CompUSA. I think my husband contacted the salesman who sold it to him, but apparently it hasn't helped. I just don't know why CompUSA or the salesman would have done it unless they were getting a kickback and I don't know how else AOL could have got our credit card number.I've always believed that AOL is the "download of death". I used their IM a long time ago, two or three computers back because a friend wanted me to, and it seemed to cause trouble. I never put it in another computer. If any of those disks come in the mail...I trash them or give them to someone I know who hangs them in their trees. They make good "scarecrows". They do make a fair coaster...but they are too dangerous to keep near a computer...where I'm most likely to need a coaster.It's like they slipped up behind me and picked my pocket.

Thank you. You gave me some good ideas. I am not sure what this one is. I'd have to look but I don't know where to look. It has way more bells and whistles then I'll ever use. It has a DVD and CD recorder and player. You can make movies but I don't have a camera anymore.

I had a person insert an AOL free trial disk into an old windows ME machine and it messed up my real internet connection. I had to reinstall to get it to work again. If I see AOL disks on display I make it a point to take a few....and BREAK THEM in the hopes that it prevents some unwary person from falling for their BS. Their service is so bad they have to resort to that kind of trickery now...word is out I guess. If you plug the hole, an AOL disk makes a great coaster.

For instance the composer with mozilla is not too bad. If you run Crossover Office (linux) you can run just about any windows office software you want. For instance, you can run macromedias dreamweaver although I have not tried. Switching to linux was one of the toughest things I have done on my puter. It is hard to overcome inertia and relearn some things. I still run a few windows programs emulated with WINE. I just got sick of having to worry about every new worm and/or virri that came out every other week. There is more to know to get stuff working but once it is up and running, its pretty decent. A good first distro for moving away from windows is Xandros (its not a free one), it has a graphic user interface for setting up and they say that if you can install windows, you can install xandros.I still have a 20 gig partition with windows XP for the odd game I cant get to run in Gentoo. If you are going to have 2 computers, try moving your stuff all to the new one and putting linux on the old one to learn it on (so you can still do everything you do now on the new one) and get a cheap router to hook them both up. That way you can see if you can do your stuff in linux. I played with gentoo linux on my old p3 for a few months before taking the plunge and switching my main machine. I prefer it but I am pretty computer savy/geeky, it may seem very daunting because things are organised differently, file systems are different, the command line is very very useful but foreign to most windows users, and it might require some tinkering.I prefer it now. The best part of windows is that it is easy to use but unfortuneatly it is to easy for other people to use...

The new Macs really tempted me, but I was so afraid of having to learn everything again from the ground up and that nothing I had would work with it. I regret this purchase, but more than anything, because of that freaking AOL. I wouldn't touch it with a ten foot pole and never have. Yet we were charged on our credit card with the first nearly thirty dollar charge for AOL service and even worse...it was part of a year long contract! We never signed anything or signed up for anything or loaded anything and they were charging us for service and saying we had a frickin year long contract! We didn’t have a clue what was happening until we got our credit card bill. Through many phone calls and nearly an hour on the phone we finally got someone at AOL to say that they would cancel our so called contract. The credit card company will not take it off the bill and AOL will not refund even though they have to know we never ever used their service. On top of that...we got a letter from AOL yesterday saying that we had to sign something and send it back...which they conveniently did not send a return envelope to send the thing back (it‘s a miracle we didn‘t just trash it without looking at it)...and on the thing they sent us to sign it REQUIRES us to put down the date we made the phone calls to cancel their criminal contract. I didn't write down the date of the calls! It's obviously some sort of thievery to say the least. We NEVER signed anything or used any of their services. I'm appalled and don't really know what to do. I don't know who did this, but it wasn't us. It could be CompUSA or HP or just AOL…somehow. I don't know and can't find out. So far, we are just out thirty dollars (so far) and phone calls, but it makes me furious. Apparently we haven't even gotten out from the stupid so called contract that we thought we had cleared up over the phone.If I ever hear of a class action suit against AOL...I want in on it! It practically had to be someone from CompUSA for AOL to have gotten our credit card number. Be careful guys...crooks at every turn!

Can I ask if you have a high speed connection? I've had my new computer for a little over a month with no problems at all. I got a DW6000 Modem that doesn't require any configuring or anything. It has been flawless and I wonder if our connections sometimes cause problems. How often do you get a new computer? My last one still works fine and is 3 and a half years old. It was starting to make funny sounds now and then but after I ordered my new computer all the noises on my old reliable computer stopped. I don't try other then Microsoft products because I can convert over without much trouble. Can you make web pages the same way on a different system? If you don't want to answer that's ok. I am just curious about different systems.

They are so cranky and prone to problems."Just get a mac or run some distribution of linux :) It's the faulty OS (any flavour of windows) that is causing your frustration (just a guess but most times it is true). I used windows since 3.0 and windows 2000/xp were the best to date but still crapola, prone to virii and spyware, inherently insecure. Since I switched to linux (gentoo) I have been sailing smooth with just one lockup (not linux just X server) in well over a month of continous use. I also upgrade and tinker all the time. I think my next puter might be a G5 mac (or an amd 64).

The first thing I thought when I saw it is that I had gone to CannabisNews so often that it had somehow burned it's way into my screen or computer permanently. Kind of like the old screens used to get images burned into them.If it weren't essential for keeping up with what's going on...I would probably have given up on computers years ago. They are so cranky and prone to problems. I've often thought that if Elvis were still around he would have blown away many a computer screen in frustration by now. I can't afford to shoot my monitor or computer...but it's crossed my mind it would be a pretty satisfying antidote to the problems...only I'd take it outside first.

Thanks for worrying. I've been here and I thought since I use CN Staff to look better on the articles I thought I'd try that with important press releases so people would check it out if they saw it in the new comments section. That way if it's my personal comment a person doesn't need to read it but they might pay attention if it's CN Staff knowing it is important. The ghost image sounds like tvs were when we had rabbit ears to use! LOL!Boy is that a long time ago!

Those CNstaff posts seem like they aren't you...but I guess they are.I never had anything like that "ghost" thing happen before. I was going to reboot, but after closing all the windows...brought up another and it was gone.

Thank you for the transcript.Hope, I haven't had a problem like that one but odd problems do happen. In the past I've had things that didn't seem right pop up. It could be isp related because I only had problems along those lines when I had an isp. Maybe re-booting will help.

Off topic and very curious
I had a what I can only describe as a ghost of something Cannabisnews lingering in all the windows I was using a few minutes ago. It was in the top right hand corner of each page...filmy...sort of see through...it said Cannabisnews and had recent comments and a little box under it with a arrow on it. Nothing happened when I clicked on it. It was in every window I had open...about ten. There is nothing that looks like it on the main page or recent comments page. I closed all the windows open at that time and started over and it's no longer there. Anyone ever see anything like that? There is nothing that is even similar to it in appearance on this website that I can find, but it did say cannabisnews, recent comments and a box like for typing in and a broad arrow.
