Bush Asks Supreme Court To Okay Attacks on MMJ

Washington -- The Bush administration yesterday asked the U.S. Supreme Court to reverse a federal appellate court ruling protecting medical marijuana patients and caregivers from prosecution by the federal government. If the high court agrees to take the case, the safety and well-being of tens of thousands of patients in states that have enacted medical marijuana laws will hang in the balance.
The case, known as Ashcroft v. Raich, was funded in part by the Washington, D.C.-based Marijuana Policy Project (MPP). Patients Angel McClary Raich and Diane Monson and their caregivers argued that because their medical marijuana activities are completely non-commercial and conducted entirely within California, the Commerce Clause as well as the Fifth, Ninth, and Tenth Amendments of the U.S. Constitution give the federal government no right to intervene. In a ruling issued December 16, 2003, the Ninth U.S. Circuit Court of Appeals agreed, holding that the "cultivation, possession, and use of marijuana for medicinal purposes and not for exchange or distribution is not properly characterized as commercial or economic activity" -- and is thus not a matter of federal concern.The case has already had an impact in federal courtrooms within the Ninth Circuit. Also on April 21, U.S. District Judge Jeremy Fogel issued an injunction protecting the Wo/Men's Alliance for Medical Marijuana (WAMM) in Santa Cruz from federal attacks, citing Raich as the basis for his ruling."We are disappointed, but not surprised, that Attorney General Ashcroft has chosen to ask the Supreme Court for what amounts to a license to attack the sick," said MPP Executive Director Rob Kampia. "This administration has waged a war against medical marijuana patients that is completely unrestrained by science, compassion or sound legal principles. Conservatives should be appalled that the Justice Department is arguing that two patients and their caregivers, growing and using medical marijuana within California -- using California seeds, California soil, California water and California equipment, and engaging in no commercial activity whatsoever -- are somehow engaged in 'interstate commerce.'"We hope the Supreme Court will let the Ninth Circuit's decision stand," Kampia added, "but seriously ill patients shouldn't have to depend on the courts for protection. A Poll In Springfield, MO - 67% Yes MMJ
Southwest Missouri State University polled 458 adults (you know how much that probably hurt LOL) and asked if terminal patients should be allowed to use medical cannabis. 67% said yes, which is lower than the nationwide average. However, considering this is home not only to john ashcroft, but is also the world headquarters of the assemblies of god cult, 67% is amazing.If 67% say yes, which is an opinion in direct contrast to the multi-billion dollar gov't anti-cannabis propaganda, there seems to be no way to stop this God-given herb from being set free when the they learn the truth.The Reverend Bud Green

I want to speak up for the Democrats.Part of the reason they are messed up is because We have not been properly influencing their walk.It is just about time to make public what I have been doing and what is about to occur.I have been getting dizzy thinking about the Democrats becoming so dumb that about a year ago I started going to My local Dem's meetings held monthly and now, tonight, April 23, We are about to accept a Democratic platform that includes some hemp / cannabis related wording. The wording that appears to be accepted, is there because of attending these meetings. After this evening, I will help bring the details of this to all Our attention. (Hate to speak about it till it's a done deal.)We need to all attend Democratic meetings and speak up. One of the things that caught Me off guard is that when I spoke up, many people out right agreed with what I was saying. It is clear that Democrats don't support the Cagings but unless We get the people to act there seems to be other items that are priorities...Attend Democratic meetings and do some work to pass legislation, educate politicians and remind citizens of the ills of caging humans for using a plant that God created and said was good.The Democratic part needs citizens to do some work and move this issue along.That is Us.

This is the Big One. The consequences of a negative verdict would be devastating to our movement. Now, considering that this issue has 80% public approval, Kerry and the Democratic-slanted media outlets should be trumpeting this case at the top of page one for weeks this fall. I'm eager to see if that happens. This SHOULD be a huge liability for the Bush cabal in election season.

I love 'em and have been voting libertarian since Nixon.But, although they promote the ideals of small non intrusive govt, ideas with wide sympathy from genuine conservatives, it does not translate into any semblance of meaningful votes (they have never broken the 1% barrier for their presidential candidate and have never threatened to or achieved an election altering vote count as Perot and Nader have with their second party efforts).I will vote libertarian again this election if FlightSuit

I mean, if this hostile towards medical usage, what lengths are they able to go to with respect to the evil doers on the recreational level.I'll take my chances on Kerry and in fact am sending his campaign a check for $54.20 with comments on the association of 4.20 with the criminal smoking class. If 5% of said class (estimated at 20 million by the feds) were to do similar, maybe we could bribe Kerry towards more enlightened treatment. Couldn't hurt, might help.Cheers.

They have no choice but to desperately protect their sacred cash cow. Millions of Americans continue to smoke marijuana occasionally, or even on a regular basis, with no ill effects.No ill effects, that is, except those which their government inflicts upon them with its war on marijuana.Nearly 700,000 Americans were arrested on marijuana-related charges in 2002 -- more than 600,000 of them for possession. Possession! Of a plant! [1]The federal government has no authority in any state to deal with marijuana. When I tell this to people they frequently don’t understand what I’m taking about. So what I say to them is this, "When we had prohibition in America we had to pass a constitutional amendment to bring prohibition to America. Congress and the President couldn’t pass a law because they wanted to, because they didn’t have the legal standing, the legal authority, to pass that law against liquor. It is a drastic measure, and it entails drastic results.Wars cost money. The federal government alone spends more than $20 billion per year fighting a war it can never win and that it doesn't want to win anyway, because declaring victory would mean that thousands of bureaucrats and "law enforcement officers" would have to go home and get real jobs.Wars produce prisoners. Today, more than 2 million Americans live behind bars -- 450,000 of them for no other reason than drug related charges -- marijuana being the most frequently cited such substance. [2] On a per capita basis, America imprisons more of its own people than any country on the face of the earth.Wars produce casualties, and this war has produced casualties beyond counting. I think often of my late friend, Peter McWilliams, a great man and a beloved author. [3] Countless others lie in their graves or crawl through their lives in terrible pain, for no better reason than to continue an immoral and unwinnable war.Wars deprive the young of their futures. Public schools impose draconian "drug testing" requirements on kids who seek to go beyond the call of duty and participate in extra-curricular activities. The federal government discriminates against students seeking financial aid to attend college if they've been unlucky enough to get caught on the wrong side of the marijuana laws. A generation is faced with submission to tyranny or the loss of opportunity.Wars direct money and power into hands they would otherwise not find their way into. Because our government bans the production and use of industrial hemp, Americans are held hostage to foreign oil, leading inevitably to even more wars to keep the crude flowing. Hemp is a viable, renewable replacement for fossil fuels. Today, right now, a few Americans drive cars powered by "bio-diesel." A fuel which produces fewer polluting emissions than normal petroleum products. A fuel which would be incredibly cheap at the pump if American farmers were allowed to legally produce and sell it. Hemp was once one of America's largest cash crops, and today, legalized, it could very well be the key to saving America's family farms.Industrial hemp isn't just for running cars, either. The Declaration of Independence and the Constitution were printed on hemp paper. It's a stronger, more durable paper than that made from wood pulp. Legal industrial hemp would mean cheaper and better paper, cloth -- and even composite timber -- for America's consumers.This is the war that our politicians defend. No wonder they shuffle their feet and avert their eyes. They're ashamed of what they're doing. And they damn well should be. The war on marijuana has damaged America economically, and its impact on the liberties of Americans has been ruinous.As a candidate for the presidency of the United States, it's my duty to offer solutions. The president can't do everything, but he can do a lot. And I will do a lot:* As your president, I'll immediately appoint a special pardons commission to expedite the release of every non-violent marijuana offender in America's prison systems.* As your president, I'll direct the Justice Department to cease and desist from its unjustifiable raids on medical marijuana facilities in states which have legalized the medical use of marijuana. I'll also direct the nation's US Attorneys to accept no further cases for prosecution which consist solely of non-violent marijuana-related offenses.* As your president, I'll veto any budget sent to me by Congress which includes so much as one thin dime of funding for the Office of National Drug Control Policy, the Drug Enforcement Agency, or any other federal activity which has as its goal the prosecution, or persecution, of non-violent marijuana users.* As a Libertarian president, my aim is to get the federal government out of education entirely. So long as it remains involved in education, however, I'll veto any appropriation or legislation which in any way discriminates against non-violent marijuana users in delivery of education or aid for education.* Finally, as your president, I will pressure Congress to repeal all federal laws prohibiting the cultivation, sale or possession of marijuana -- including industrial hemp, medical marijuana and recreational marijuana. I will protect marijuana users from the federal government. States will no longer be guided by the federal laws on marijuana. As I helped to get medical marijuana laws passed in Nevada, I will use the bully pulpit of the presidency to encourage the states which have not already done so to eliminate their prohibition of this common and useful plant. No war is more vicious than a war declared by a government upon its own people. No politician who pledges to continue such a war, or who acquiesces in prolonging it, deserves your support.It's time to elect a president who will end the war on marijuana and usher in a just peace. And that's just not enough blood for Bushy Boy and the rest of his vampire bunch. Bushy Boy is addicted to death and misery as long as it's not his own. Being Governor in a death penalty state was just a gateway to harder, more addictive, murderous ways. The Bushit Administration has no regard for the Constitution they all swore to uphold. Call the military back from overseas to uphold their own sworn duty: to protect the people from attacks both foreign AND DOMESTIC.
