In another sign of the state-federal split over drugs, a state appellate court ruled Tuesday that possession of marijuana pipes is legal in California, just six weeks after bong-sellers around the nation were the targets of federal raids. The Court of Appeal panel in Riverside County said a 1975 California law "deliberately decriminalized the possession of a device for smoking marijuana. " The same law changed marijuana possession from a possible felony to an infraction punishable by a $100 fine. 
But federal law, which overrides state laws, continues to classify marijuana among the most dangerous narcotics, in the same category as heroin. Federal prosecutors have stepped up raids on medical marijuana suppliers in California and won convictions, though the state legalized medical marijuana in 1996. On Feb. 24, federal agents raided more than 100 homes and businesses throughout the nation that sell bongs and pipes favored by pot smokers. Fifty people, including six in Northern California, were charged with trafficking in illegal drug paraphernalia. Hold on, the Vapir is not all that
I had to speak up here... the Vapir is actually NOT the best vaporizer you can get by a long shot. It doesn't work that well at all.On the other hand there are a few that work very well. For half of what the Vapir costs, a Vapor Brothers vaporizer ($125-150) is far better. For around the same as the Vapir ($250?) the Volatizer is very good (again MUCH better than the Vapir) and works with a special glass bowl/stem that fits on any glass bong. For the well heeled there's the German-engineered Volcano ($400 or 500 I think) which works like a dream but has you suck your vapor out of a plastic bag/mouthpiece combo (kind of like a big cannabis breast).I have a Vapor Bros and believe you me it is really nice once you get used to it and dial in your technique (takes about 10 vape sessions). It is a whole different experience fromn smoking. Once I started vaping I was astonished and filled with remorse at what I had been doing to my lungs and throat and mouth for 25 years by smoking. But federal law, which overrides state laws, continues to classify marijuana among the most dangerous narcoticsFirst let me say that what is now up at MichaelMoore.com seems very appropriate to the above. People are living in a world of fiction and to think cannabis is a narcotic is one fiction and to think it a dangerous narcotic is nightmarish fiction. Television is dangerous. It induces a state of blissful ignorance. Does anyone else wonder why the word overrides is always used. Is it some kind of brainwashing? My word would be "independent." California has their laws and the federal governnment has theirs. In Richard Cowan's commentary yesterday- http://www.marijuananews.com/news.php3?sid=661 - he includes this paragraph saying that Kubby could face trial for a federal crime of growing plants that got him acquitted in state court because of the Compassionate Use Act.The second problem is that the Feds have three more years to decide whether to prosecute the Kubbys for the cultivation of the plants for which they were acquitted under Prop 215, and there is no medical necessity defense allowed in Federal courts.

So does this ruling just mean that the State of California will not bust you for bongs but the feds still can?

I remember the Fox article. Dr. Russo and I talked about it. I didn't post it because it seems he is referring to tobacco and he agreed that wasn't what he was trying to say.
