Judge Closes Hearing in Noelle Bush Case

Chief Circuit Judge Belvin Perry Jr. in Orange County closed a hearing this afternoon where he was scheduled to hear arguments whether four subpoenaed workers at the drug-rehabilitation center where Noelle Bush is receiving treatment must answer police questions about reports she had crack cocaine.Carlos Burruezo, attorney for the Center for Drug-Free Living, where Gov. Jeb Bush's 25-year-old daughter is staying, asked that the hearing be held in the judge's chambers out of the hearing of the public, citing federal confidentiality laws.
Amie Kozan, an attorney representing the Orlando Sentinel, objected to the hearing being closed. Kozan said confidentiality regulations, intended to keep patients' records private, should not apply. She said the issue was whether the four center workers should cooperate in the Orlando police investigation that Bush had crack cocaine in her shoe last week.Perry disagreed and retired to his chambers to conduct the hearing. Before leaving the courtroom, he said he would not have a ruling until Monday or Tuesday as to whether the co-workers will be compelled to talk to investigators. Arrest Prohibition
I don't understand. Is it not the law to arrest the people in posession? So, if a worker refuses to talk, just arrest that worker, like any other poerson posessing, right? I have a friend here who spent ten days for 2.5 grams of cannabis plu paraphernalia charges. His eyes opened wide when I told him the Governor's daughter was free on her fourth offense, with one felony prescription charge. I think he is going to sue Florida. (grin)
