  Prosecutors May Change Marijuana Limits

medical Grass Valley, CA -- Limits on the number of marijuana plants people with doctors' recommendations are allowed to grow in Nevada County may become more stringent in coming months, as the district attorney-elect re-evaluates local standards for cultivation of the drug.

Grow lights for an indoor medicinal marijuana farm may have allegedly sparked a fire on Rapp Road in Penn Valley last Friday that destroyed a two-story farmhouse; the renters had valid recommendations to grow marijuana.

No arrests were made and fire officials say the cause is still under investigation, but the incident is one of many that has caused local law enforcement officials to examine the pitfalls of local medicinal marijuana standards.

"There are some serious concerns regarding the size of grows in residential communities," said Nevada County District Attorney-Elect Cliff Newell, slated to take office Jan. 8. "There are dangers from fire, and people trying to rob fields as plants mature. I know of large grows where there are children running around and people use dogs to guard (plants)."

He said in coming months - before the growing season starts in May, 2007 - he will meet with law enforcement officials to develop new standards for growing.

California voters passed Prop. 215 in 1996, which allows Californians to cultivate and possess marijuana for medical purposes, although possession of marijuana for any reason violates federal law. Local jurisdictions drafted standards on the amount of marijuana people with valid doctors' recommendations can have.

On June 14, 2000, Nevada County law enforcement officials including District Attorney Michael Ferguson, Nevada County Sheriff Keith Royal, Grass Valley Police Chief John Foster and Nevada City Police Chief Lou Trovato signed a memorandum of understanding clearly outlining local standards.

The document states, "Based upon verification of a valid or written recommendation and absent evidence of sales or possession for sale, a person with such a recommendation from a physician shall be allowed to possess no more than 2 pounds of marijuana. Such person shall be allowed to cultivate between five and 10 marijuana plants; however, the expected yield from such plants should be no more than 2 pounds of processed marijuana."

But in the years since the agreement was reached, people have consistently exceeded the allowable amount.

"They're entrepreneurial in their growing," said Nevada County Sheriff's Lt. Ron Smith. "People are taking advantage of the law."

Newell said modern growers have become more sophisticated in their cultivation, cloning plants to create all females and genetically altering plants to produce higher quality and quantity.

"The technical capability of growers has increased from 10-15 years ago," he said.

Many homes with marijuana farms are tended by several people, each with their own medical recommendation. And several doctors in the area, he said, willingly write recommendations.

"Everyone has a recommendation," Smith said. "There are a lot of them. I see young adults with recommendations and I think 'What could be wrong?'"

He said many young people tell him that they are using marijuana to treat depression.

He said he supports people who use the drug for valid medical reasons, such as treatment for chronic pain or nausea from chemotherapy, but those cases are in the minority.

And the large indoor grows, he said, are posing a risk to the public.

"There's no guidebook on how to set up a grow," he said. "There's Mylar for the walls, a lot of wiring, lights, timers and fertilizer. It can get dangerous."

Newell said he will take Smith's and others' concerns into account during his re-evaluation.

"I'm not going to make any unilateral decisions without consulting with doctors and law enforcement first," he said. "It is reasonable to assume we'll be lowering the amount grown."

I thought it would be in the news, too. It hasn't been though, that I have seen.

She has done so much for the free cannabis movement for so long. She deserves to have us rally round her, no doubt.

Kevin Zeese knows Kay Lee. He was with Kay Lee and the rest of us on the Journey for Justice in Texas. I know he would do something if he could, and knowing him...he's a good lawyer...maybe he knows of something that will help her fend off the prohibitionists.

(I haven't fixed my e-mail yet or I would try to e-mail him...a tech call is called for and I haven't done it yet. Mail comes in...but doesn't go out.)

Anyone out there who can contact Kevin Zeese...please check to make sure he knows what's happened to Kay Lee. Please.

I don't know anyone in our community in Atlanta or Wisconsin. What confuses me about the situation as related is that proposition 215 is California law, but has no force in Wisconsin or Georgia or any other state.

Do you know of Her,(a 215 patient) or heard of anyone that is talking about her or what she has done to help others.

i hope that a fund is set up to help those that have given everything for this effort -- fighting heart attack and leos wanting the healing herb that is helping her.

A story about her in major news outlet must be done.

any help for Kay will be good for everyone.

Before the visit make sure that the following items are made safe also:

1. Make safe all sharp knives around the kitchen (&house)

2. All Tobbocco and alchoholic products should be locked in cupboards (and only used after childs bed time hours)

3. The petroleum or burning systems around the premesis must have the highest safety exhaust rating and only used on breezy days for fear of Carbonmonoxide poisoning.

4. Make sure all the water is filtered from the toxic elements, pollutants and flouride.

5. Any childrens or adult pharamacuticals (especially anti-depressants) need to be accounted for and a pill audit taken. Also if child is under this medication, be prepared to issue a law suit against the Pharamacutical manufacturer for not putting clear and damning lables explicitly warning of the suicide risks associated...

etc etc etc...

It hypocrisy to it's worst level.

Ya be prepared...

Depression
Many young people use Cannabis because it DOES relieve the stress and depression associated with being 19 years old in the U.S., today.

The biggest health hazard they face is INCARCERATION.

A medical recommendation saves lives.

This is very distressing concerning Kay Lee.
Many of you know who Kay Lee is. She's a tireless activist for our cause and prison reform.

She is a wonderful woman and human being.

This was in a letter on our DPFT list...so it's public knowledge.

All this happened within days of the killing of Kathryn Johnston in Atlanta.

From the letter:

I think they may have removed the story about the 120 year old pot smoker - the link leads to a non-existant page. Do you happen to have the story on your machine? I'd love to read it. By the way, I was arrested last night. I'm 63 years old and have never been arrested before. I have a question hopefully someone may be able to help me with. I live in Atlanta. I came up here to Wisconsin to visit my daughter this summer. I'm still here only because of a heart attack and open heart surgery. Doctors are still adjusting my meds. My daughter had an episode with her dog the other day and I thought animal control came 4 or 5 times, but it actually turned out to be a police officer. He stated on the last visit that he smelled marijuana, asked who it belonged to and to keep my daughter's family out of it I quickly stated that it was mine, that I am a Prop 215 patient, and just had heart surgery. I had my paperwork, heart meds and scar to prove it. I gave him my pot to keep him from bringing dogs to find it. He was gentle, apologized, said he understood medical use but that Wisconsin has no medical provision. He did arrest and cuff me but didn't read me my rights. At the station they were also gentle, took my picture and fingerprinted me, charged me with "THC possession", warned me not to leave town, and sent me home. I go to court on Jan. 2nd. I've been working with anti-drug war people, the marijuana movement and the effort to rehabilitate the prison system for years. In fact WI is the very state where I did the first Journey for Justice. So at least I'm prepared to handle whatever comes. The main thing I'm worried about is my daughter and her family because the offense took place in my room at her home. She has an eight year old son. I'm not sure what to do when child services comes as the cop said they would. I have a lock on my door so grandson can't come in, but I don't know if that will be enough to give the family plausible deniability or protect him. Any ideas of what else I can do to prepare? Thank you so much for any suggestions. Kay Lee

Agreed, education is the key here though. How many arrests are carried out by police who SHOULD know much better?

I mean, the police role is a social one of course, so taking out the 'job' and the 'pension' aspect, would allow a more open view of the medicinal and other users of the ~7000 year old herb.

Sounds like the average Americans garage, except the garage has 20 plus gallons of flamable liquids in it.

What about the bathroom? Water,curling irons, Chemicals, Fans, Bright lights, Razor blades and Drugs. Worse yet, we encourage our children to visit the bathroom. No sir, I'm laying out newspapers on the floor, and hose them off outside. I would take the bathroom out, but City code require's me to have one. I'm more affraid the person next door might have 3 bathrooms in his house, just an accident waiting to happen. I just know one of his bathrooms will burn my house down. And my children, what if they got in his bathroom? We must pass a law's to put and end to this danger!

NO GUIDE BOOKS? If this idiot could find a keyboard with both hands, then go to amazon & type in the word marijuana, he'd realize what an asinine statement (and the article is full of 'em) that is.

Oh, and I'd better unplug my tv, refridge, etc..they've all got lots of wiring. Lights, timers and fertilizer and all in the same room? It's a wonder the news isn't filled with nursery's going up in flames every single day.

I would love to meet the person who is genetically altering Cannabis in thier home. They most have spent millions on equipment and lab space. Not to mention I would love to see a complete genome map for cannabis Sativa, Cannabis indica, and Cannabis ruderalis. The cops must think that cannabis growers are all phd's.

Oh my God! Imagine that! Mylar, wirings, lights, timers and even FERTILIZERS!!!! What are these crazy potheads thinking!!

What they want with these growing limits is making pacients unable to supply themselves with cannabis so OR they´ll have to treat themselves with legal drugs and give $$ to the big corporations, OR they´ll ignore the limits, breaking the law so the cops are able to arrest them... At least those pacients that need big amounts of cannabis...

I love the logic of Police Lt. Piggie E. Bacon. Using cannabis for depression is not a "legitimate medical reason". People are guarding their plants with dogs! Oh my god! Half of the state of Maine is guarding their property with dogs.

Don't look now, "Officer", but the entire pharmaceutical and medical industry (read: doctors) is profiting from SELLING DRUGS for depression.

They use pharmacies guarded by bulletproof glass, and highly sophisticated banks to store the money, with vaults, armed guards, cameras, the works. And the best part is, the whole racket is protected by a HUGE crew of armed thugs, looking to mess people up, with big guns, cars, body armor, tear gas, electrocution, everything! Cops! Oh wait a second, I guess you already knew about that part, didn't you?

Worst yet, several THOUSAND doctors are willing to write recommendations for DRUGS to treat depression! Childred are running around!

My god, "children are running around" people HOMES with DRUGS! Aieeeeee! Run! Children!!!
