Marijuana Bill Simply Sent Off To Its Execution

medical Santa Fe -- Speaker of the House Ben Lujan got Rep. Joe Stell of Carlsbad to do his dirty work for him this past session and ensure that a medical marijuana bill passed early in the Senate would never be heard in the House.

It was Stell, and not Lujan, who had to sit by stonefaced as frail, 61-year-old AIDS patient Essie DeBonet wailed repeatedly through heavy sobs, "Why are you trying to kill us?" after he cast the deciding vote in denying DeBonet the only medication she says will allow her to deal with the nausea caused by her disease and keep down the food she needs to stay healthy.

It was by far the most dramatic and heart-wrenching moment in a legislative session that otherwise sputtered to an inconclusive finish.

In truth, the bill never should have been in Stell's committee.

Lujan made his displeasure with the bill known shortly after it passed the Senate, telling New Mexican reporter Steve Terrell, "I would have hoped that the first bills passed would have addressed issues that are more at the forefront of what the general public really wants."

He vowed that he would not keep the bill from being heard, and then did just that by referring it to Stell's Agriculture and Water Resources Committee -- a conservative committee made up entirely of rural legislators.

Rep. Joseph Cervantes, who serves on that committee, pointed out the obvious when he noted that the bill had nothing to do with water resources or agriculture. Whatever agricultural expertise would have been required to carry out the bill, if it had passed, is pretty much common knowledge on the Internet.

"This bill is here for a reason. It's been sent here to kill it," Cervantes told his fellow committee members before they voted to make that prediction a reality.

It happens all the time in the Legislature. Leaders who don't want to be bothered with controversial bills send them off to a hostile committee, never to be heard from again.

It is why New Mexico is one of only two states that still allows cockfighting. Sen. Mary Jane Garcia's bill to ban cockfighting died last year in the Senate Conservation Committee following a full afternoon of testimony, including that of a man who said it was more cruel to spay and neuter a cat. That is the logic that won the day.

The medical marijuana bill dealt primarily with two issues -- medicine and law. Cervantes, an attorney who chairs the House Judiciary Committee, is the only member of the Ag Committee with any expertise in either of those two areas, and the only member who supported the bill.

The only other lawmakers taking part in the discussion with specific expertise in either of those two areas were Sens. Cisco McSorley, an attorney, and Steve Komadina, a physician. And they were both there to support the bill. Sadly for people like Essie, they didn't have a vote.

"Lawsuit". As in 'wrongful death'.
Kap, you're right. I was so afraid they were going to kill him. The only consolation I could think of was, that at least, if they did, Michelle and the girls would have enough money to likely live the rest of their lives well on the proceeds from the lawsuit that WOULD HAVE TO HAPPEN if he died in that jail.

Afterburner, old Tom was right. "... our calamity is heightened by reflecting that we furnish the means by which we suffer."

"The teaching of the savior, and the revelation of the mysteries and the things hidden in silence, even these things which he taught John, his disciple."

And because they were held in sacred silence in the closet of the soul, those knowledges and wisdoms have continued to reside there, untouched and uncontaminated with the Pharisees doctrines of each age.

The followers of that path know the story of "The Pearl of Great Price" and keep it hidden from the 'eyes of the world.' Such profundity is beyond the ability of man to withstand collectively at this time, thus there are 'Seals.'

The way is there, the right thinking, right behaving, right aspect of being, is all laid out in a map that needs only childlike sincerity to percieve. The error is in the world view, and the fears of humanity which fertilize the fields of corruption.

The 'locking of the way' done by constraining doctrines (defintion of 'religion'= to constrain or hold back) says that no revelatory experience, is/was possible after the advent, that the common gift to man of his conscience was no longer a personal responsibility, but thereafter delegated to the 'authority' of 'christ.'

"You cannot 'talk' to God, only 'jesus' can do that!" (Funny how them telling me that didn't stop my own inner conversation with my creator. But of course I met Him before I met the 'church.')

Therefore the only 'righteousness' available to man is through the 'intercession' of -you-know-who.

Thus it is prudence which even we can understand the wisdom which adjures us to 'pray in secret,' not to put on public displays of 'piety.' It is prudence which tells us that some pearls should be kept safe and hidden.

thanks

free at last, free at last, thank God Almighty
from: http://www.kubby.com/

In jail, Kubby lost 25 pounds, yet said he gained respect for his jailers and the medical staff who tended to the rare - and typically terminal - form of adrenal cancer he has been treating with marijuana for three decades.

"I realized the taunting and skepticism about my condition that I experienced when I was first jailed here in 1999 was not present with any of the jail staff this time," said Kubby, a onetime Libertarian gubernatorial candidate and early backer of California's watershed 1996 medical marijuana initiative. "I realized that these guys were getting heat over me, and they didn't deserve it."

The first days of his incarceration were marked by loud criticism of Placer County officials by medical marijuana activists who worried that Kubby might die in jail without access to marijuana. His blood pressure, normally 120 over 80, jumped to 170 over 120 and blood appeared in his urine.

But soon after he arrived in the Placer County jail, Kubby started using Marinol - a legal, synthetic form of THC, marijuana's psychoactive ingredient - to thwart increases in his blood pressure that doctors say could be lethal.

His condition stabilized, and Kubby wrote to his jailers and the medical staff apologizing for negative publicity during the first days of his incarceration. In the letter, Kubby said he had "developed a profound respect for the professional and highly dedicated staff and officers here."

The short note eventually found its way to Placer County Sheriff Ed Bonner, who met with Kubby last week.

"He said it was an honor to meet me," Kubby said Monday after his release. "I was floored. I got the feeling he was sincere, genuine, and got it. He said he wanted to talk to prosecutors about burying the hatchet."

sorry
The teaching of the savior, and the revelation of the mysteries and the things hidden in silence, even these things which he taught John, his disciple.

And it happened one day, when John, the brother of James - who are the sons of Zebedee - had come up to the temple, that a Pharisee named Arimanius approached him and said to him, "Where is your master whom you followed?" And he said to him, "He has gone to the place from which he came."

The Pharisee said to him, "With deception did this Nazarene deceive you (pl.), and he filled your ears with lies, and closed your hearts (and) turned you from the traditions of your fathers."

When I, John, heard these things I turned away from the temple to a desert place. And I grieved greatly in my heart, saying, "How then was the savior appointed, and why was he sent into the world by his Father, and who is his Father who sent him, and of what sort is that aeon to which we shall go?

It was the hard drive. With the good directions from the link that CQ posted my husband took the drive from a computer we have that has a dead motherboard and put the hard drive in my main computer. I got done last night installing and updating everything and it's just like new.

I hope it keeps working like this because it is quiet and doing a fine job. Thanks for asking.

hope this helped in some small way
Congratulations Steve Kubby,

As you likely know already or will soon, the commissary checks I sent to you and Jerry included a copy of the fax I sent to Placer Co. and the media. I'm not so naive to think this was the last straw, but if it helped in any way, I am proud to have done what I could with what resources were available.

I hope you run again for Governor, sir. You and Loretta Nall deserve the gigs after all you've been through.

Hello Josh, Arthur, Tom, Nick, Linda, Jonathan, Paul, Clifford and Rich:

Since you all work at nytimes, I would appreciate if at least one of you would cover the Steve Kubby political and medical marijuana persecution.

You don't need to tie the whole can of worms together for your readers including DynCorp, Merck, Coca-Cola, Chevron, Exxon-Mobil, NIDA, ONDCP, DEA, Wolfowitz and Iran-Contra, or even Harry Anslinger and DuPont, if you don't think they can handle the truth. Just save the guy's life, for Lord's sake, it's not so much to ask that you cover a corrupt and unjust prosecution. Right? (Ahem)

Anyway, below are some news tips on this preposterous injustice, please do follow up instead of waiting for the man to die. He's lost 25 pounds in a few weeks so far, as his verifiable adrenal cancer requires more than the cost prohibitive and synthetic THC he is _currently allowed to consume in jail_.

Drug war IS crime. We have Proof.

To Whom it May Concern,

A phone call was received from 530-268-8874 claiming that the following fax was sent in error.

After reviewing the contents, it was determined that the caller was most likely misinformed, and we do request and will require that the following be received and filed in affidavit form in the Steven Wynn Kubby case, under Judge Cosgrove.

Suppression of precise and pertinent exculpatory evidence will be and is currently being pursued to the fullest extent of civil and criminal law.

Editor,

How ironic that Superior Court Judge John Cosgrove would utter the words "I don't see that Mr. Kubby is eligible to another sentencing" when denying former Libertarian California gubernatorial candidate and medical marijuana consumer Steve Kubby a fair sentencing hearing (No resentencing for medipot advocate, March 5).

Perhaps if exculpatory evidence about marijuana hemp were not suppressed in courtrooms across the country, those who would deny cannabis' efficacy and safety under oath would be at risk of felony charges for perjury and fraud.

The existence of Cesamet, Cannasol, Marinol, Acomplia Sativex, Cannasat, Nabilone and whatever federally funded cancer drugs and palliative care(1) techniques are or may soon be promoted by the prosecution's star witness(2) from U.C. Davis, shows marijuana prohibition is capricious at best and may ultimately prove to violate many existing U.S. laws.

Certainly Steven Wynn Kubby, the man before "Justice" Cosgrove has repeatedly demonstrated that malicious prosecution and incarceration verifiably affects his health to the point of near death. Also and in fact, cannabinoids indisputably reduce tumors(3) and regulate pain, stress, nausea and weight issues far more safely and with more palatable side effects than almost every approved medication on the market.

Mr. Kubby wants another sentencing, not "just because he absconded," but because he deserves a fair hearing and not a witch trial in absentia. Willful blindness and stubbornly ignorant behavior from a kangaroo court(4) is consistent with an apparently well documented subculture of intellectual dishonesty and corruption throughout the law enforcement and judicial industries, and discredits us all.

There are none so blind as those who will not see.

3. "Cannabinoids and their derivatives exert their effects via "central" CB1 receptors, mostly expressed in brain and responsible for cannabinoid psychoactivity, and "peripheral" CB2 receptors, mostly expressed in the immune system and unrelated to cannabinoid psychoactivity. Cannabinoids may be potential antitumoral agents owing to their ability to induce the regression of various types of tumors, including lung adenocarcinoma, glioma, and thyroid epithelioma. Although cannabinoids directly induce apoptosis or cell cycle arrest in different transformed cells in vitro, the involvement of this and other potential mechanisms (e.g., inhibition of tumor angiogenesis) in their antitumoral action in vivo is as yet unknown. Researchers in Madrid have recently addressed this area using skin carcinoma as a model system. CB1 and CB2 receptors were identified on both neoplastic and non-neoplastic epidermal cells as well as human skin, keratinocytes, and carcinomas. Stimulation of these receptors using a mixed CB1/CB2 agonists caused apoptosis in transformed but not nontransformed epidermal cell lines or primary human keratinocytes. Furthermore, the CB2 agonist, was able to induce tumor regression in vivo. This effect was related to an increase in apoptosis and a decrease in angiogenesis, which in turn was related to an inhibition of EGF-R activation."

Someone must have mentioned the magic word
"Lawsuit". As in 'wrongful death'. That's what his jailors feared.

But now, something else has happened. Everyone familiar with the case - on both sides - now have proof positive of the medicinal qualities of cannabis and cannabis derivatives. But they have also been enlightened as to the obvious benefits of 'natural' 'raw' cannabis as opposed to the artificial sort that Mr. Kubby is limited to.

His health wasn't suffering before he was forced to cease taking the natural herbal form, and he is barely surviving thanks to Marinol. Should he continue to survive this latest attempt on his life by The State, he will stand as a public rebuke of all the lies told by the DrugWarriors about the value of 'crude, raw' cannabis. (Are you reading this, "Doctor" Barthwell?)

Mr. Kubby's continuing trial by fire was much more than a personal struggle; it was a turning point. If anyone thinks the 60 MINUTES Marc Emery program was damaging to the DrugWarriors, what do you think the Kubby incident would do to them? Time to start calling CBS...

I Hope
it was the jailers that forced a decision to release Kubby. It gives me hope that there may still be a spark of humanity within the beast. Of course it could be they feared legal repercussions if Kubby died, and acted in their own interests by distancing themselves from the crime.

Either way is good, one shows they may have a spark of decency left, the other shows that they realize we aren't silent victims anymore, and the is going to be consequences for the harm that has been done.

Kubby's Release
So it was the jailers that insisted he be let out?

That's wonderful. I know it's because they were afraid they were going to be responsible for killing him...but that's an excellent reason. I'm so glad they weren't so cruel as to carry out the judge's and the prosecutor's wishes.

The jailers? That's just wonderful. The jailers were ones getting the mail, too. I'm so grateful.

I wish the jailers for Jonathan Magbie had cared.

Society vs. Government
"SOME writers have so confounded society with government, as to leave little or no distinction between them; whereas they are not only different, but have different origins. Society is produced by our wants, and government by our wickedness; the former promotes our happiness POSITIVELY by uniting our affections, the latter NEGATIVELY by restraining our vices. The one encourages intercourse, the other creates distinctions. The first is a patron, the last a punisher.

"Society in every state is a blessing, but Government, even in its best state, is but a necessary evil; in its worst state an intolerable one: for when we suffer, or are exposed to the same miseries BY A GOVERNMENT, which we might expect in a country WITHOUT GOVERNMENT, our calamity is heightened by reflecting that we furnish the means by which we suffer. Government, like dress, is the badge of lost innocence; the palaces of kings are built upon the ruins of the bowers of paradise. For were the impulses of conscience clear, uniform and irresistibly obeyed, man would need no other lawgiver; but that not being the case, he finds it necessary to surrender up a part of his property to furnish means for the protection of the rest; and this he is induced to do by the same prudence which in every other case advises him, out of two evils to choose the least. Wherefore, security being the true design and end of government, it unanswerably follows that whatever form thereof appears most likely to ensure it to us, with the least expense and greatest benefit, is preferable to all others." --Common Sense by Thomas Paine, 1776 http://www.ushistory.org/paine/commonsense/singlehtml.htm

No, FoM, I haven't had any problems
But a mutual friend, Sukoi, has been unable to post anything on CNEWS. I've been trying to help him but haven't had any luck; he keeps getting 403 errors when he tries.

And I can't say how glad I am that Steve Kubby is out of that hell-hole, but it's only because of the pressure of those who've written and called. Don't let up; the swine trying to kill him (yes, they KNOW DAMN WELL WHAT THEY ARE UP TO, AND WE'RE CALLING THEM OUT ON IT) think we'll forget, so they can do him in when no one's looking.

What he's gone through already proves the medical efficacy of 'raw' cannabis, when a nominally healthy person becomes as ill as he has thanks to the (contemptuous spitting) 'tender mercies' of the Placer County officials. Richard Cowan is bang on target with his analysis. They're scared his death will be laid at their feet, and rigthly so.

He has every right to sue them for what's happened. And a punishingly expensive lawsuit - on top of the God knows how much has been spent on bringing him down - would sear into their minds that some expenses never have to be made. Like Steve Tuck, they've clearly endangered his life while it was in their custody. This is far from over.

prayers
I've been praying that they not kill him. Yay! He's out. I'm so thankful. That's wonderful.

Now we have to look to get Jerry out before they do him any more harm.

ASA Upcoming TV Event
ASA: TV Premier of Documentary 'Regarding Medical Marijuana,' Tomorrow

Mofilms and Americans For Safe Access are proud to announce the TV Premier of the documentary Regarding Medical Marijuana.

This 30 minute movie features interviews with people from both sides of the struggle surrounding this issue, featuring appearances by Dennis Peron (Prop. 215), George H.W. Bush, Michael Moore, Ed Rosenthal, John Walters (Office of National Drug Control Policy) and others.

It is a hard hitting look at Medical Marijuana in the modern day, particularly relating to the California front line battle to distribute and buy a medicine that under state law is legal, yet under federal law is still a Schedule 1 narcotic.

This powerful documentary was the winner of the People's Choice Award at the Compassionate Use Film Festival, hosted by Americans for Safe Access in February 2004.

It will air Tuesday March 7th 2006 on 'Free Speech TV', channel 9615 on the DISH network. It will show 6 times in the day.

For a complete schedule schedule go to http://www.freespeech.org/schedule/index.php?date=20060307

If you do not have the DISH network, they have a list of affiliates that it may be showing on, go to http://www.freespeech.org/html/affiliates_list.html

Please spread the word about this Premier, pass this message on...pass this message on... pass this message on...

THE WILL OF THE PEOPLE BEING SUBVERTED!
After the former Governor of New Mexico appeared at a NORML Conference, after hearing about a Medical Cannabis Bill was submitted to New Mexico legislature, I was pleased and felt that progress was being made. Now we have the bad legislators seeking to subvert the will of the people!

Here in New Jersey there is a similar problem. N.J. State Senate Health Committee Chairman Joseph Vitale, who has a highly secure office on Main Street, in Woodbridge, New Jersey, REFUSED TO POST THE S. 2200 MEDICAL MARIJUANA BILL FOR A VOTE! Afterwards, then-U.S. Senator Jon Corzine promised during N.J. State Governor's campaign debate to sign any Medical Marijuana Bill that comes to his desk. What has happened? After the New Jerseyans voted for him [a Democrat], N.J. State Assemblyman Reed Gusciora submitted a Medical Marijuana Bill in the State Assembly and N.J. State Senator Scutari [who is also the municipal prosecutor for Linden] submitted S. 2200 Medical Marijuana Bill. I have not heard of ANY progress on these Med Pot Bills, either.

That teacher in Denver Colorado High School is absolutely correct that Bush is a Nazi! A retired attorney at law, John Loftus, worked for the United States Department of Justice Nazi Hunter section. He has written a book entitled THE SECRET WAR AGAINST THE JEWS, wherein he details his information that the Grandfather and Great Grandfather of U.S. President George W. Bush, along with Rockefeller, financed 40% of Adolph Hitler's steel manufacturing, until around 1951!! They also provided shipments of Standard Oil of New Jersey [later named Esso, later named Exxon] to Adolph Hitler, during an Oil Embargo. A federal district judge ruled they committed Treason, but it was not published. ANYBODY CAN OBTAIN THE DETAILS IN THE ARTICLES HE HAS POSTED ON HIS WEB SITE: WWW.JOHN-LOFTUS.COM. Other books say that both George Herbert Walker Bush and George W. Bush do not care about ANYTHING EXCEPT THEIR OIL, PHARMACEUTICAL, AND OTHER BUSINESS INTERESTS!! THEY DO NOT CARE ABOUT AMERICANS. WHY DO YOU THINK THEY FAILED TO DO ANYTHING AT ALL ABOUT THE ILLEGAL MEXICANS INVADING THIS COUNTRY????!! BECAUSE THEY STAND TO PROFIT BY ALLOWING THE HISPANICS TO TAKE JOBS AT LOW WAGES AND WITHOUT EMPLOYMENT BENEFITS [1 IN EVERY 7 AMERICANS IS NOW A HISPANIC!!! YOU CAN SCREAM I'M A RACIST AS LOUD AS YOU PEOPLE WANT: I DO NOT LIKE THE ILLEGAL ALIENS!!]. I heard that New Mexico declared a State of Emergency because of the illegal Hispanics bordercrossing! Law enforcement resources should be directed towards enforcement of laws aimed to stop dangerous behavior. Cannabis does not inspire illegal behavior.

How Does He Sleep at Night???
"It was [Rep. Joe] Stell [of Carlsbad], and not Lujan, who had to sit by stonefaced as frail, 61-year-old AIDS patient Essie DeBonet wailed repeatedly through heavy sobs, "Why are you trying to kill us?" after he cast the deciding vote in denying DeBonet the only medication she says will allow her to deal with the nausea caused by her disease and keep down the food she needs to stay healthy."

This is public service? This is protecting society? This is "promot[ing] the General Welfare"?

It's what I figured!!
What else can you expect from a state that has drive through liquor stores where you can buy hard liquor and beer from a pass through window 24/7. They have the highest rate of drunk drivers anywhere in the country. I wonder why????
