Drop The Pot Provisions In 'Methi-juana' Bill

cannabis Alaska -- In 1975 the Alaska Supreme Court ruled that the state's constitution affords its residents a right to privacy protecting them from prosecution for possessing small amounts of marijuana in the home. To this day that interpretation stands as the law of the land, with privacy implications extending well beyond the drug war.

In 2006, Alaska is trying to get ahead of a health and safety scourge - methamphetamine manufacturing and sales - that has ravaged parts of the Lower 48 and increasingly threatens Alaskans.

What do the two have in common? Nothing, which is why lawmakers now reviewing a proposal to crack down on both methamphetamine cookers and marijuana possessors should rip the bill in two.

On Wednesday the Alaska House rejected a combined drug-enforcement measure approved by the Senate, and some representatives objected to proponents bypassing their chamber's vetting procedures by lumping the drugs together. Some also objected to removal of a log-book requirement that would allow police to track people who buy meth's core ingredients over the counter from pharmacists.

The bill approved by the Senate also would criminalize home possession of 4 ounces of marijuana, the legislated amount previously considered small enough to be covered by the court precedent.

The Senate legislation now faces conference negotiations with the House, in which it should be split up and the marijuana provisions dropped from further consideration. Where in-home possession of marijuana is essentially a personal decision, right or wrong, methamphetamine manufacture and use present both environmental and public safety dangers.

Meth users pose a danger to many around them, not least police officers, while meth cookers create health and safety hazards for their neighbors. Merging an unconstitutional anti-marijuana measure with a necessary attack on meth-making amounts to a sneak attack in the name of election-year pandering. The marijuana ban deserves its own examination, through the complete legislative process, and then it deserves to be dumped as a waste of state effort and money.

The bill's proponents, including the Murkowski administration and its Department of Law, reject the Supreme Court's precedent and want another day in court. With this legislation they are trying to make a case that today's marijuana is not your 1975 hippie's marijuana, but instead is much more potent. They note that laws against cocaine possession have survived privacy-based challenges because cocaine can be a killer, and argue that today's marijuana is more menacing than yesterday's.

But the Alaska Supreme Court has declined administration appeals to review the issue, and as recently as 2004 the Alaska Court of Appeals rejected the state's claim that it could execute search warrants for small amounts of marijuana. Nothing is new here except the year and the election cycle. Passage of the Senate's so-called "methi-juana" bill would merely ensure that police would invade someone's privacy and that the state would follow up by prosecuting that offender only to be shot down once more for violating the Alaska Constitution.

Meth and marijuana present vastly different physical, social and legal issues. They deserve separate consideration in the Legislature.

Wishful Thinking About Steve Kubby
Wouldn't it be good if somehow Steve could use Sativex? I'm sure that's not possible but it would be great if it could hppen.

I feared this. I knew the jail wouldn't pay for it...and good grief...who could, besides maybe Mel Sembler?

We are all just North America now. We are global and we work with Canada. Canada has water, oil, beef, lumber and we have goods that they want and need. They need to clean up Vancouver for the Olympics. They don't want to have people from other countries come to Canada and wonder why they are so different. I guess I look at an issue like this in ways that others might not.

It looks like perhaps the new conservative government elected in Canada has thrown down the gauntlet as promised.

Once Canada is just like the US, (yikes!) where will the sensible Americans threaten to move to when things get too goofy?

vergrow.com, Cannabisworld.com, Heaven's Stairway Seed Company and Eurohemp.com Owners Apprehended

Cannabis Culture has developed a timeline of events we believe accurately account for the disappearance of Overgrow.com, Cannabisworld.com, Heaven's Stairway Seeds (hempqc.com), and Eurohemp.Disclaimer: this is an ongoing investigation, and facts may not be correct until confirmed!

On Monday evening, resident of Montreal Richard Calrisian, the owner of the four websites, was contacted by his web service providers in Vancouver where his servers were situated. They told him that there may be a problem, regarding a police investigation. RC told his provider to shut down the websites immediately.

Within hours, the RCMP (or other police) apparently entered the server site in Montreal (not Vancouver, as previously reported) with a warrant and apprehended the hardware that housed the four web sites.

In the early morning of Tuesday, police in Montreal moved in and arrested RC, his wife, family members and an unknown number of employees.

It is alleged that RC, a pseudonym, is being held at Riviere-des-Prairie (RDP) jail in Montreal, and his wife in is Tanguay jail, across the river from RDP. Cannabis Culture called the prison and found no one there under the name Richard Calrisian.

The bail hearing should be on Monday, but it is unusual that a bail hearing has not yet been held. Typically they take place within 24 hours of arrest, unless an investigation is ongoing and the accused are being held temporarily without bail. This may be because there is a risk that the arrest news might inform other persons who are also under investigation.

Earlier reports of a drug bust in Hearst, Ontario are not related the seizure of Overgrow.com websites.

found this
I did not want to wake up to this headline on CannabisCulture this morning:Overgrow.com, Cannabisworld.com, Heaven's Stairway Seed Company, and Eurohemp.com Shut Down and Servers Seized by Canadian Police.

Now it appears Heaven's Stairway Seeds (hempqc.com), Cannabisworld.com, Overgrow.com, Eurohemp.com have been shut down and the owners arrested in Canada; all their web properties seized, including the physical servers that held massive databases on thousands of growers, and tens of thousands of photographs of cannabis plants. Seed companies by the dozens used both Overgrow.com and Cannabisworld.com as a main trading ground. Over 40 seed companies had customer service interactive forums on these sites.

All the information held on those servers is now in the hands of police. It is not known what charges have been laid nor against whom. That police have not boasted about this seizure means the investigation is continuing, before any affected parties can react.

Steve Kubby's Marinol supply is running out
Steve Kubby's Marinol supply is running out. May die in jail. by eco man Sunday, Feb. 05, 2006 at 8:17 AM

Marinol (THC, a cannabinoid found in cannabis) is costly, and Michele Kubby reports that they need money for more in a few days before they run out. Marinol is legal, yet the jail will not pay for it. Even though jails are supposed to provide medical care and drugs in jail. The Kubbys are broke, and Steve could risk death again from a blood pressure spike from the adrenaline produced by his cancerous adrenal glands if he doesn't continue to use cannabinoids. Steve almost died the first day in jail when he was without the use of any cannabinoids.

Michele Kubby reports at kubby.com that the jail is not paying for his Marinol, and that they do not have enough Marinol. http://www.kubby.com Jails are supposed to provide medical care and drugs. Marinol is a legal drug. But the authorities hate even admitting that Marinol (THC, a cannabinoid) works. Marinol is very expensive, and Michele is asking for help in paying for it. The Kubbys are broke.

Don't ever forget that Steve Kubby almost died the first day or 2 in jail. He reported the worst blood pressure attack he could remember, blood in his urine, and was starting to go blind in one eye for awhile. The authorities are quite willing to let him die. They have proved that the last 2 times that he has been jailed in the Placer County jail in Auburn, California.

Info quoted below is from the kubby.com homepage.

Quote: ----------------------------------------------------

CONTACT FROM MICHELE TODAY: 2-4-06

6-day EMERGENCY!

Michele just called me with some information.

Steve is not going after the use of the whole plant instead of Marinol. The reason for this is because in order to actually receive the whole plant, he would have to say that the Marinol was not working at all. Since the Marinol is controlling his Blood Pressure, Steve would have to perjure himself in order to get the whole plant.

Placer was going to argue that the Marinol was working and that he could keep using it instead of receiving the whole plant. He didn't want to lie and open that can of worms, so he just decided to drop the motion.

However, there are more important things right now.

Steve has 6 more days of medicine left. A company in Canada has volunteered to send some medicine to Michele for Steve to be able to use while incarcerated, but it has not arrived yet. The jail is not going to provide Marinol to Steve, an Michele does not have the money to obtain the amounts needed for Steve.

If you know of a Cancer Foundation that can help Steve get the medicine he needs and the proper treatment, please email me right away at jeremy@freecanadianparty.org and I will get in touch with them to see what they might be able to do for Steve.

I'm glad that this paper finally decided to write an editorial against this. What took so long? I can only hope it was because they were waiting for the Sunday edition. Though if they had passed this bill straight through, this editorial would have been too little too late. It's one thing to speak out on something when you have 20/20 hindsight and can just agree with the outcome and another to speak soon enough to prevent something from happening.
