Sonoma Judge Keeps Marijuana Patient in Custody |
Posted by CN Staff on January 26, 2006 at 06:44:33 PT Press Release From NORML Source: San Francisco Sentinel Santa Rosa, CA -- A Sonoma County court declined to release Prop 215 medicinal marijuana patient Will Foster from custody over his Oklahoma parole violation, but ordered a further hearing on a motion that would let him be released on bail. Attorney Terence Hallinan had asked that Foster be released on bail pursuant to a habeas corpus motion. However, Judge Eliot Lee Dunn declared that he could not grant habeas corpus without a full hearing, and in the meantime he could not release Foster in view of Oklahoma's "no bail" extradition warrant. Foster was arrested during a routine ID check while dealing with the police over a burglar alarm that had gone off on his property. Police alleged that he had a warrant for failing to report to parole authorities in Oklahoma, where he had been released after serving four years of a 20 year sentence for marijuana cultivation. Hallinan, a former San Francisco District Attorney, said that the violation was due to a miscommunication by California parole authorities, who had failed to keep contact with Will. Judge Dunn indicated that he was sympathetic to Foster's plight in view of the fact that his alleged crime would have been perfectly legal in California. However, he said that his own hand were tied by the law. He suggested that Foster pursue his case in another forum, citing the example of the native American activist Dennis Banks, whose extradition order by South Dakota was turned down by then Governor Jerry Brown. Dunn ordered a full habeas court hearing on February 27th. In the meantime, Foster must remain in the Sonoma County jail. Today's Santa Rosa Press Democrat reported that the county is considering doubling the size of its jail on account of the flood of drug dealers and other miscreants. Yesterday I read a transcript of the recent Gore speech (so can you at http://www.scoop.co.nz/stories/HL0601/S00121.htm ), and found it so eloquent and filled with truth that I wondered whether he wrote it or some speechwriter did. If Gore himself wrote it, then I am really in awe not only of his command of the English language, but of his intelligence and grasp of the big picture regarding the mess we are all in. I agree with you. Why does anyone support him or republicans? We are so in debt now. So much for what the republicans are supposed to stand for. Seeing clips of Al Gore's new documentary made me feel a little better. I hope Al Gore was able to enjoy being around the people at Sundance that think like we do. [ Post Comment ] |

It's embarrassing to have a bumble headed President who can barely speak coherently.
How did such a person get elected to the President of this Nation? I know people said, "well, he's like a guy you can talk to , go have a beer with." I think, why would you want the stupid drunk at the end of the bar to be your President! What really amazes me is not that some may have been blind sided and not seen what this administration is about, but rather all of these conservatives that voted on fiscal conservatism, spending concern, limited government control, ethics and perceived competency, still show support for this bunch in office after 6 years of their actions...which are far from these conservative values!
