| Pot Seeds Might Not Produce High Court Says Legal |

Oregon -- Smoking marijuana seeds may give you a headache, but it is apparently perfectly legal under state law, according to the Oregon Court of Appeals. Pendleton resident Cameron Scott Beers, 27, was busted in 2002 for driving under the influence and possession of less than one ounce of marijuana, an infraction. On appeal, Beers claimed that he shouldn't have been convicted because all he had on him were seeds. And state law says "Any person who knowingly or intentionally is in unlawful possession of less than one avoirdupois ounce of the dried leaves, stems and flowers of the plant Cannabis family Moraceae is guilty of a violation, punishable by a fine of not less than $500 and not more than $1,000." Although the law doesn't mention seeds, the Court of Appeals considered whether legislators might have made a mistake. But the court rejected that idea after noting that lawmakers had included seeds elsewhere in state law. "The omission of seeds from that list of marijuana plant components was apparently not an oversight," the court wrote Wednesday. David T. McDonald, a Portland attorney who has handled a lot of marijuana cases, said the ruling appeared to clear the way for legal seed-smoking, at least under state law. "I'm not sure it would generate the desired effect," McDonald said. "But it appears to be OK." Note: State law - The law barring most marijuana use in Oregon omits the word "seeds." | Ok, upon reading that, doesn't it also omit resin? Is it legal to possess hashish now too then? What about pure THC extract, i.e. hash oil? [ Post Comment ] |

| Here is how they list the taxonomical order of cannabis. Since most of you aren't bio majors, I added what they mean--I might be wrong on a couple, it's been almost 40 years since I was a bio major. Eukaryota (its cells have a nucleus), plantae (it's a plant), tracheophyta (I think this means having tubes in the stems), angeospermae (has seeds), dycotyledonae (the seeds are in two parts like a bean),rosales (belongs in the same order as roses?I'm not too sure about this), CANNABACAE (cannabacae is the name of the FAMILY cannabis is in and this is where the law goofs up!), cannabis (this is the genus), and finally, sativa/indica/ruderalis (the species names we all know and love). I don't know about you, but I didn't see moraceae anywhere on the list. Wouldn't it be neat to bring in the new year overturning the Oregon law? If it does, I might even move there! | I was up late partying with my hubby and my mind is still a bit fuzzy this morning, but wasn't there some debate a quite a while back about whether cannabis was actually in the family Moraceae or not? If that is so, doesn't it mean that the whole law is invalid? Law is very picky about details. If there is no plant called cannabis in the family Moraceae, (cannabis would belong in a different family), the law would be referring to a nonexistant thing! Cannabis belonging to the family of whatever-it-is is a totally different thing than cannabis family Moraceae. [ Post Comment ] |

| I'll probably burn in hell for asking but I just had to wonder? :) Would sure piss off the cops if somebody set up shop in Oregon and only sold seeds within the state! I'll bet somebody tries to monetize this oversite just like in Arizona a few years ago. Again I'll state that cops got no business trying to regulate what they can't understand.
