A landmark DUI case |

On January 7, 1998 I witnessed a case, which was declared a mis-trial due to an to emergency. The re-trial shall be sometime this April, 1999. The case is entitled: State of Washington vs. Lucas Werner. Mr. Werner's charges are as follows: 1- Possesion of marijuana The third charge against Mr. Werner is a unique one for no one has ever been arrested for DUI Marijuana before. The officer claimed that he smelled marijuana in Mr. Werner's car, gave the defendant a field sobriety test, searched his car, and arrested Mr. Werner for driving under the influence without proof, other than paraphenalia found under the seat and marijuana found not on the driver, but the passenger. The arresting officer forced Mr. Werner to submit to a drug analysis, threatening to impound his car and suspend his liscence if he did not commit to a 'mandatory' anaylis at the hospital. Figuring that this was an important news story, I acquired Mr. Werner's home phone number thru public record.
