  Hutchinson is Wrong About Drug-Treatment Issue

justice The Ohio Drug Treatment Initiative headed for this November's ballot would overhaul the state's drug war, offering treatment instead of jail time for nonviolent offenders.

A Buckeye State Poll shows 74 percent of voters want to see it happen. Meanwhile, a tone-deaf Gov. Bob Taft is leading the charge to "just say no,'' often distorting the measure in the process. Now comes the nation's drug cop telling Ohioans to oppose the initiative.

Drug Enforcement Administration chief Asa Hutchinson tells us Ohio is doing just fine with drug offenders and that we don't need to expand treatment options ("Drug treatment needs accountability,'' Forum column, May 14).

In his column, Hutchinson said, "Treatment alone too often becomes a revolving door.'' He said "accountability" is needed in treatment. He argued that the criminal- justice system must monitor addicts closely and punish their transgressions. Great. Supporters of the ballot measure, including me, agree with all these statements. That's why we want to see this initiative approved by voters. It has all the elements the Hutchinson would want. But for purely political reasons, he turned a blind eye to each of them.

For instance, drug offenders placed in treatment under the ballot measure will be subject to urine testing and other daily monitoring. Treatment providers, probation officers, independent experts and judges all will be watching each offender's progress. A major section of the initiative spells out how the court should react to program violations with sanctions and intensification of treatment. The ultimate "accountability'' is a jail or prison sentence. This consequence hangs over the head of every person in treatment under the terms of the ballot measure. The court can remove a noncompliant offender and ship him or her up the river.

But Hutchinson said the initiative "robs judges of their power'' and "would remove the critical court oversight and accountability.'' Both claims are simply false, as anyone reading the initiative can see.

Hutchinson touted the state's current drug-court system as the alternative. What's the difference between that and the initiative? Not much, except the initiative would instantly make every court in Ohio a drug court.

Hutchinson called drug courts a "realistic'' program that "accepts relapse as part of recovery.'' The initiative says, similarly, that relapse should be understood as "often a part of the process of recovery signaling the need for a consequence or increase in the level of care.'' In both systems, judges try to keep a person in treatment while there is hope for recovery. Everyone seems to understand that jails don't cure addiction.

Drug courts offer treatment for up to one year, and "not,'' Hutchinson said, "for 90 days.'' If Hutchinson is claiming that the initiative limits treatment to 90 days, he is simply wrong. The initiative provides up to one year of treatment upon entry, and in some cases, treatment could be extended to 18 months.

The philosophies are almost identical, but the initiative promises a much bigger system than today's drug courts. Most counties don't have a drug court. Half of the four dozen drug courts do not serve adult offenders, who go to jail if treatment is not available. Only one in four drug-possession offenders has a chance to enter such a program. We can do better.

What's worse is the sacrifice we are making by offering treatment on a limited, case-by-case basis. We are losing a generation of young people, especially blacks, as a drug arrest and the resulting felony record explode into a life of addiction, criminality and unemployment. Just 11 percent of Ohio's population is black and only 13 percent of drug users are black, but 77 percent of the people sent to prison for drug possession last year were black. This brings shame to us all.

The Ohio Drug Treatment Initiative will change the system. No wonder those who like the status quo, from the governor to the DEA chief in Washington, oppose this intelligent reform.

If you took a month off, we'd all understand! No news, is good news as they say, and a busy week is ahead, guaranteed! The eclipse will make sure of that! The next three months will be incredible as anything that needs to be exposed, will be! You're right C News has been taking a sort of holiday. This war we fight is really hard. I believe burn out can occur. I also believe that mental rest can strengthen us for what is ahead. I know that with the important medical marijuana issues coming up the news is going to get crazy. We've come too far to turn back now. You are a very interesting person.

I have always identified with the Star of David for some reason,,I am not actually Jewish,,but my Jewish friends accept me as an honorary Jew.(?)...... 70's music, like the sports cars of 73-74 was hot.

One of the things on my mind lately is J.D. Blackfoot's The Song Of Crazy Horse. Anyone remember that one? The song is over 18 minutes long and so was primarily played on alternative progressive rock stations, and the hippies etc. "It won the album of the year in 74 in New Zealand.

you can be sure that "treatment" will be as abusive as possible and ruinous to everyone subjected to it. the Straight program exemplifies the prohibitionist's ideal in treatment. if the government could get away with it, nothing would please it more than to exterminate all marijuana smokers and even all those who do not object to marijuana's right to grow. this "treatment" law will probably pass and it will only make life worse for those who benefit from marijuana. the law will allow the government to prolong and even intensify its persecutions - and it will be able to carry out the intensified persecutions at less expense, the whole ruse of "drug court."

did you notice this: "drug offenders placed in treatment under the ballot measure will be subject to urine testing and other daily monitoring." Other Daily Monitoring? I'll leave it George Orwell and dddd to figure out what Other Daily Monitoring means. I don't want to think about it.

This law is not reform, and I would bet that Hutchinson knows so and is opposing it only to sucker baby reformers into supporting it and not wanting to be such an odd ball as he is for opposing it. it's a lose-lose deal. there's nothing positive to vote for, there's no choice and no possibility of meaningful reform is offered.

I remember perfectly well how it was impossible to have a useful discussion of Vietnam in the 60's. Americans can get mad, they can get red in the face, they can mindlessly repeat the same tired slogans for decades on end. if a debate on mj were televised today it would be the most tiresome and jejune debate ever held: asa would say, "marijuana is a dangerous and addictive drug that destroys lives." johnson would retort that "enforcement costs too much. by the way, drugs are bad, don't smoke marijuana." and asa would counter, "treatment backed up by accountability [Jail] costs only 25% the price of imprisoning first time offenders, and our pilot programs have been 78% effective in halting the spread of addiction." and the american people would say "gee, that sounds reasonable. i'm for reform. i'm for treatment of marijuana addicts." americans can mindlessly repeat sound bytes: "treatment," and a powerful and deciding majority is incapable of taking ten seconds to competently think about any issue or to even be aware of the facts staring them in the face.

the only time i can think of when a few americans gave the authorities their comeuppance was at the trial of oj simpson. twelve jurors decided to 'just say no' to a crooked police department. their verdict had nothing to do with oj, only the police. for sure, oj belongs in prison. but money and the hiring of very brainy jury selection professionals able to draw psychiatric profiles from background investigations, questionaires, and the clues of body language and manner of dress, managed to identify and select those few jurors from a pool of hundreds. i'm sure that the same money and the same professionals could identify a dozen people, selected from a pool of hundreds, who might, after months of coddling and humoring and always being sure not to use any big words, be brought to vote for an end to the drug war persecutions.

the war on drugs will end when america ends, when freedom ends, when the grocery stores are empty and abandoned, the electricity is off, bodies dead from disease are strewn over the streets - then the drug war will end. you'll be able buy a crust of stale bread and a few joints from a rich government official, your girl on his arm and his car in your driveway. America is all about bigotry, hatred, abandonment of thought, and, by god, tough-minded brutal answers to the slightly subtle problems that George Bush has been hired to solve.

..I hear ya....I read the story,,and I read it again in your link..I agree,, it's a Shocker!,, but I guess that most people are somewhat numbed to shocking stories nowdays...Just think,,where is the public outrage concerning the undisclosed energy meetings at the whitehouse involving Enron,,and where are the law enforcement people to lock up swindlers like Kenny boy Lay?.....Where is the investigation into the matters surrounding the pre 9/11 knowledge of an attack?,,..It seems as if no one cares,,but I think that alot of it,,is that it is just made to appear,as if no one cares.I think alot more people care than we know about,,,but because the media downplays,and suppresses dissenting viewpoints,we never hear about anyone like you and me who are really PISSED OFF...dddd

It didn't surprise me and I wish it had but I think I have become so cynical that nothing shocks me anymore. My husband is a Vietnam Vet and the things that went on with him and others during his tours ( he did two tours ) in Nam taught me a lot about how the government only thinks of a soldier as a killing machine.

Navy gassing
I posted a link to a story that blew me away, yet no one, including the mass media, is talking about it, even though the pentagon admitted it.

In 1964 and 1965, my lifetime, our Navy, on 4 occasions, used nerve agents (including Sarin, the gas used in a Tokyo subway attack,) on our sailors confined on one of our ships!

These are the people saying "TRUST US!" I say "SCREW YOU!"

...I just saw one on FOX,,,"I helped kill someones father"....."I helped kill a policeman"......man,,those ad make me PISSED!...... I wanna see an ad with dubya,,saying,,"I allowed Texas energy companies rip off Billions from California consumers."..........It's too bad revolutions are no longer allowed..yup,,revolutions are against the laws of the empire......and it's a good thing,because if revolutions were legal,,,it would be a good time for one!

I understand what you're saying. I am very worried about that very thing happening. As far as having good treatment programs for people who are having a tough time with hard drugs I think that is a good thing. What concerns me is if a person is forced into treatment they more then likely won't stay clean. I just think it is contrary to addiction if that makes sense. Giving up an addiction is a choice a person makes. How can anyone force a person to clean up?

A person will only quit doing hard drugs when they have to quit and for their own reasons. How can forced treatment work and be an effective tool?

.....Again,,,....If you are strung on crack,meth,or heroin,,,,treatment may be better than prison,,,but with Marijuana ,the treatment game could easily become a nightmare,in that it has the potential to delay Marijuana law reform....why,,you ask?....my theory is;,,that once "treatment",becomes more recognized,and the empire drugpigs have been forced to accept it,,,,two things will happen....first,they will only allow "treatment",on their harsh terms,and through their own conditional funding,and national "standards",for treatment programs.,. The federal drugpig/empire will showcase their new "compassionate treatment programs for drug offenders".They will lead the public to believe that they have eased up on harsh drug laws,with their kinder,and gentler compassionate treatment laws...and just like Asa said in the above article,,these "treatment" programs,will be administered with THREATS of incarceration,as opposed to actual therapeutic rehab..In other words,,instead of making sure that these "treatment" programs are healing the emotional,and mental problems of addicts,,they will intead focus on making sure that the "drug offender" goes to jail if he tests positive...

..... ..secondly ,,and even more fucked,,will be the fact that;once "treatment",is a common thing,,Marijuana will be purposely lumped in with crack,and heroin,,and this will tend to further the confusion amongst the Sheeple, that somehow,Marijuana is a substance that a person needs to be "treated" for!..it will be like training dogs,,with shock collars,or telling a dog that you will lock him in the cage,if he doesnt behave the way you want him to... Murderers and rapists belong behind bars....People like Kenny boy Lay,and Dick Cheney belong behind bars for stealing,and cheating Americans...People who smoke pot do not belong behind bars,or in "treatment" programs.......

....I think this is an extremely significant factor in all this!...If "treatment",programs for "drug offenders",,are brought into law before Marijuana laws are reformed,,then Marijuana will be somehow legitimized as a "drug problem"........after all,,,if Marijuana was not an addictive, problem,,"drug",of "abuse",,then why would we need to have "treatment"?........just watch,,they will play this game as long as they can..They will use any and all ploys they can to confuse,and delay the Marijuana issue.....We are dealing with a HUGE,,organized group,that is funded with Billions of our tax dollars...The empire has blended the drug war into the terror war,and if you think things look promising,,then I dont want to pop your bubble,and I dont mean to diminish anybodys hope,,,,,,but I think we are dealing with something that is much worse than we think.!!..We are talking EMPIRE here!,,,we are talking about trying to reform drug laws,,that are part of a government that passed the usa/patriot act in less than a week!....We are dealing with a government that refuses to release information to the public about even the most basic matters!...............THINK ABOUT IT!...The empire has been issuing these "terror alerts" ,and the national media has been conveying them..These "alerts",are so obviously bogus, unsubstantiated, and contrived,,,that I'm starting to wonder if the American people are actually so stupid,that they dont see through this bullshit!...We have heard these "warnings",and "alerts",,and they are always reported as "uncorraberated",,and "non-specific",,about possible attacks on trains,planes apartments,shopping malls,national landmarks,,,etc!...These alerts are reportedly from "al-quieda suspects who are in custody",,or some sort of "activity" in communications.....THIS IS FUCKING ABSURD!!!....this is ridiculous....it's really an insult to all Americans..What IDIOT would take these "alerts" seriously? .. These terror warnings are the equivelent of a warning on a coffee from McDonalds that says;"caution,coffee is hot,",,,,or,,my favorite,,the warning on fireworks that says;"light fuse,get away"..,,or the warning on a power saw;"do not allow blade to contact fingers",,,,and of course,,the very top of the ladder says "Not A Step"............ Heart attack alert;.dont eat too much deep fat fried bacon,or butter cream smoothies........Beware,,you may get in a traffic accident sometime soon..........Warning Alert,,If you get really old,you will probably die!............

Who recognizes those song lyrics?..The first one to correctly guess the artist,and song,will recieve a vacation for two in Southern California with me and my dog,lil'Bill,,as your hosts!....plane fare is not included,,but lodging and meals are!...I will provide a comfy pair of cots here in my small studio shack,which is less than a mile from the beaches of Surf City,and the Pacific ocean...Ethnic cuisine will be provided,along with transportation....AND,, on top of all this,,I will include free treatments!..........
