Ailing Canadians to Sue for Promised Pot

medical Kitchener, Ont. — Nine Canadians who are allowed to smoke marijuana for medical reasons plan to launch a civil lawsuit this week against the federal government in an effort to ease access to pot.

The lawsuit, to be announced at a news conference Thursday, will demand that Canadians who have legal exemptions to smoke pot be given access to experimental marijuana crops being grown by Health Canada in an abandoned mine shaft in Flin Flon, Man.

In the lawsuit, Toronto lawyers Alan Young and Leora Shemesh will also ask judges to rule that existing pot laws are unconstitutional.

"The Liberal government should stop the double-talk and admit they're conning the public," said Catherine Devries, 44, of Kitchener, Ont., who is named in the suit. "They say marijuana is available but they have no intention of providing it for medical reasons."

Ms. Devries, who buys marijuana from Kitchener dealers or from compassion clubs in Toronto and London, Ont., suffers painful spine and bowel conditions.

She said Ottawa should distribute cannabis through pharmacies the same way other narcotics are dispensed.

More than 250 kilograms of the federally sanctioned marijuana has been harvested and is sitting in a secure storage area.

Health Minister Anne McLellan has said she won't release any of the marijuana to sick and dying patients until it has been tested in clinical trials first.

A scandal of another sort brewing
And our Canadian brethren are right in the middle of it.

Down here in The States, it's: "What did Bush know, and when did he know it?"

For the Canadians, it might be: "Did the Chretien Regime deliberately sabotage the MMJ operation...and was it at the behest of the US?"

A blind man could sense that something was afoot as soon as the time limit set by their Supreme Court was up. Parliament pulls this rickety, paper-thin excuse of a 'test program'...then it says the weed might be trash...which has to be 'studied'...before it can be distributed. If ever...

This has DEA practically dripping from it. The puppet strings are hardly invisible; Mr. Chretien has made no secret of his unwillingness to grasp the bull by the horns and deal with it. Perhaps he should be asked what pressures have been exerted by the US to prevent the Canadian MMJ experiment from its natural completion...and inevitable success?

So the question is, and remains: Is Canada a sovereign nation or the 51st State? Canadians have a chance to answer that question, in possibly the most forceful way they can...by their support of drug law reform.

One thing to consider: the US economy is still shaky after 9-11. Any trade sanctions that the US attempts against Canada will hurt the US...and the Europeans have no compunctions about stepping in and relieving the US of its lucrative trade agreements (hint, hint, hint).

Woohoo
hempcanadian, you are going to be one the heroes of this war..the change is coming...canada is on the verge of declaring it's independance from the united states and declaring itself to be a country...oh wait.....heh..sorry:)

Seriously tho, it seriously feels like change is coming, and coming fast for canadians..well not FAST, but definitely faster than whats going on in the states..GB will probably decriminalize in the next couple years, if not sooner..The US is falling behind the world FAST..and yet, the US keeps going backwards more and more quickly. Let's face it. Until Bush and the 'old boys system' (and it DOES exist boys and girls) are gone, nothing will change...There is NO middle ground in the states anymore, "you are with us or against us" was how i believe the first shot was fired in this latest battle of our longstanging war of government vs citizens.

I think of Canada and the US and i wonder...how did the 'land of the free' become Canada??? What has happened to us here in the states? Even the MASS MEDIA is questioning what Bush knew..Something very bad is going on in DC if the mass media is starting to tell the truth again..Every time i look to the sky now, i find myself looking northward..The Canadian Supreme Court has ALREADY ruled that prohibition is illegal..they gave the government a year to create a BETTER system...their 'system' isnt even OPERATIONAL yet! Granted i do not know much about Canadian governmental structures, but isnt their supreme court like the US one? Once they rule on a law, that's it? Their ruling stands?

It will be a very sad day if the canadian government crumbles under the US pressure. The US already has it's tendrils in canadian land. Vancouver...what a fitting spot..what fortunate planning that the DEAth office was placed in the future "SUPER KILLER WEED FROM SPACE THAT MAKES YOU TERRORISTS" capital of north america..BC Bud..coming to a propoganda ditribtion nearest you..

Canada, be strong for all the american who have forgotten how to be courageous and free..show the world what freedom REALLY is...tell the DEA you dont need them there and make them leave..they have NO right to be there..tell them the 'drug' they are looking for is now your number one LEGAL cash crop and provides you with almost everything you need to survive on...then boot em right in the ass

Canada
is presently facing app. 8 such cases. Any one of them will make prohibitionists squirm funny, for the last time.

Any one of these type of lawsuits may well end cannabis prohibition, in Canada. And unless Bush is successful in rebuilding the German wall on our northern boarder, the farce is over.

For it not to happen may only occur within a blatent bought and paid for US court,,, and that could trigger Biblical revolution, in Canada. There are too many Canadians that do not want to share their pee with Bushee.

This is just one facet of displaying how we are winning this war. Bush et al. are enjoying their urine mustaches today, but will drown in what they ask for.

circular logic
"It cannot be tested until it is tested, once it has been tested then it can be tested, until then it must not be tested, because it is illegal to test, and anyway might be dangerous in some way, which we cannot, will not and indeed refuse to know until it has been tested..."

some clarity...
The Canadian Supreme Court ruled that the Canadian government had one year to allow the sick access to marijuana or all laws governing marijuana would be null and void. In the last days before that year ended, the Canadian government made up a new scheme under which some sick people can now get exemptions to use marijuana legally, thus saving marijuana prohibition (at least temporarily).

The petitioners of that original case are indeed following through today, as there are several cases currently underway in the Canadian courts. The argument of the plaintiffs is that the new rules do not allow easier access but indeed make access more difficult while the government maintains that the new rules allow sick people access and therefore meet constitutional muster. In addition to court challenges of the new rules for the sick, at least one case is arguing that laws prohibiting marijuana for any adult is unconstitutional. I guess we'll see, but I sure wish things would hurry up!

Now I'm REALLY confused...
...maybe somebody can clear it up for me. Haven't the Canadians already been down this path? The Supreme Court has already declared Canada's marijuana laws to be unconstituional. Are the petitioners from that original case following through today?
