  Canadian Court Rules Kubby Not Fugitive

medical Vancouver -- Former gubernatorial candidate Steve Kubby was cleared on Friday of any violations of Canadian Immigration law. Canadian Federal Court Adjudicator D. Shaw Dyck found that Kubby had entered Canada legally.

Adjudicator Dyck also ruled that because of alleged political persecution in the United States, Kubby was eligible to apply for Canadian citizenship as a U.N. Convention political refugee.

The refugee appeal process is expected to take at least a year and could take a lot longer, as has been the case with Renee Boje, who has been waiting several years for a final decision on her political refugee status.

Adjudicator Dyke also ruled that since Kubby was not a fugitive, he no longer has to report weekly to Immigration and can now report monthly instead.

Dyke noted that possession of peyote is legal under Canadian law, so Kubby's U.S. conviction for peyote possession has no legal standing in Canada.

The adjudicator also noted Kubby "has been completely honest and up front with Canadian Immigration and in view of his public statements and permission from the Placer court to move to Canada, is hardly a fugitive."

Dyck noted that possession of live mushrooms is legal and only the dried form is illegal, in Canada. She also acknowledged that possession of a small amount of dried mushroom would probably not be prosecuted in Canada.

However, since Kubby was convicted in the U.S. of something that was technically illegal in Canada, she was required to declare Kubby inadmissible until the sentence for the mushroom stem had been served.

The prosecution for the Canadian Immigration Service then argued that Kubby should be immediately deported to face his U.S. sentence of 120 days. He argued that Placer Judge John Cosgrove had gone out of his way to be compassionate to Kubby, even providing written orders that Kubby be allowed to be protected by the Compassionate Use Act while under house arrest and probation.

Kubby's immigration attorney, Alex Stojicevic, responded that although the US court recognized Kubby's right to possess and use medical marijuana, local and federal law enforcement blocked any access to it. Stojicevic argued that Kubby was not allowed to grow any of his own medical marijuana forcing him and others to buy and transport the medicine to his home. Since the courts have ruled that transportation is not covered under the Compassionate Use Act, Kubby was physically and legally unable to comply with his sentence.

Stojicevic also explained to the Canadian judge that there was ample scientific and medical evidence to show that Kubby would die if denied his medical marijuana for more than a few days -- "so despite the trivial nature of his conviction, he faces death if he returns to the U.S."

"Mr. Kubby is a member of a particular social group or political opinion who are being persecuted in the United States. As such he is entitled to apply as a political refugee under the UN Convention, which is recognized by Canada." said Stojicevic.

Adjudicator Dyck then ruled that Kubby met the qualifications and was qualified to apply along with his family for Canadian citizenship.

Kubby joins three other Americans who have officially applied for political refugee status in Canada: Ken Hayes, Steve Tuck and Renee Boje.

"Once again my husband was jailed and nearly killed over charges that proved groundless. A Canadian court has confirmed that Steve is not a fugitive and I think the Canadian police and courts now recognize that they were lied to by Placer County officials," said Michele Kubby.

Yes I think June 6th is right. I am very worried about what they could try to do to other cannabis clubs. I don't barely watch the news anymore on tv. It is so out there and not important to the general well being of us that I can't handle it. I'm very happy for the Kubbys. They've fought strong and hard and it's great news when you see someone's efforts pay off. What is happening in the catholic church scares me. I mean that. The church will fall. ( I think I can say that because I was raised catholic) I can't understand why the church let this happen. When morality issues are raised about people who consume an herb and they slap the hands of pedophiles I just don't get it.

Excellent thread. I hope Steve Kubby is able to find some peace now. He deserves it.

The rancor present in some of the earlier posts should tell us something. We have a common cause. We don't all have to agree about everything. We need only agree on one issue.

Fear and dissention have done more to harm our cause than any other factor. If we had stuck by our guns and demonstrated, en masse, in the 70's this war might already have been won. Instead, after Viet Nam ended, most of us went on with our lives. We were busy raising a family and achieving stability. The anti's never let up. Now they are more entrenched than ever. We can win, but unity of purpose is a must.

If I recall correctly(FoM, help me here) Judge Breyer will give his final ruling on Cannabis Clubs' right to distribute medicine on June 6th(?). I think the DEA will be closing every known club in California and elsewhere, within the week. There may be mass arrests of those who own, or participate in these Compassionate Facilities. Many clubs are closing their doors now, to avoid a direct confrontation.

If you are a patient relying on these clubs for medicine, do your homework now. There will be those who will go underground to provide for your needs. It may be too late after 6/6.

It's about time we had some good news! There IS a government that is not COMPLETELY corrupt! That cool clear air up there must be affecting Canada's judges. This is a great boost to the momentum of this issue.

I guarantee you the Placer county folks are running to the feds right now, crying for mommy. But what's the response going to be? Do Bush & Asscroft want to appear in the media as starting a trade war with Canada over this case? On the medical marijuana issue? It would be real bad PR for them. Remember, lack of public attention is the No. 1 reason the WOD continues. Making a big stink over Steve Kubby or Rene Bojee is going to be very difficult for the Bush administration. It will put very likeable human faces on this issue.

Until this regime is un-installed, we have to be aggressive in our efforts to disseminate the information that you won't see in the mainstream press, although it seems the damn has a huge leak these days and it only going to get bigger. It is delightful to hear that Steve Kubby is considered a political refugee. Freedom of choice regarding what plants to eat, smoke or drink should not be prohibited. Canada is forward thinking enough to see this. Racism created prohibition, but lets not get so sensitive that everything is racist or anti-semitic. It is clear that the middle east has been in war between the two religions for a thousand years but which side is NOT a terrorist. I don't like racism or anti-semitism but BOTH sides should look at what their leaders are doing AND question them.

It's been mentioned here and elsewhere, that the anti-US (as opposed to anti-Americanism; there's a big difference) feeling in Canada is bound to have some spill-over or spin-off effects. This may well have been one of them.

But also think that it may very well be the gathering groundswell of a phase of activity on the part of Canadians culminating in their Supreme Court re-legalizing to spite Washington.

That's not as far-fetched as it seems; the troubles the Canadians have been having with the US playing hardball concerning the hardwoods trade matter was just a cooker set at boil for too long. Yet the incident has not made a single blip on the radar screens of most Americans living beyond the border.

But this one issue will. This smacks Uncle right across the snout. No dodging this...especially when Walters is supposed to be in Quebec shortly, to give the Canux a stern scolding for even thinking about the (for antis) unthinkable of re-legalizing. No getting around this...ad no dodging the Court's claim that the Kubby's warrant refuge status.

This is a stinging blow to the US Department of (ha-ha) 'Justice'. They had hoped to make such political capital out of capturing the Kubbys. They wanted to hold their sad incarcerated selves up to others and say, "They defied us, and we ground them to dust and killed one of them legally...just like we did with McWilliams. Speak up, and you'll get yours."

(Does anyone here doubt for a moment, given the Kubbys visibility and vulnerability, that the thought hadn't crossed the minds of the Fed scum who had done it before? To let Steve Kubby die in a holding cell?)

Instead, they are left with empty hands and boiling blood pressures. And cannabis consumers have been granted political asylum!

I am too old and cynical ever to think we'll win hands down; the politicized human-trash-in-Brookes-Brothers-suits who run our so-called legal system will always find a way to leave their mark on you. But this is the best news we've had in a long time, and bodes well for all those considering the possible (inevitable for some of us, I sadly say) need to relocate.

As many Americans said some 23 years ago when the Canadian embassy in Tehran harbored US citizens - at enormous threat to their own safety - I say again: Merci!//Thank you Canada!

Most posters here seem to understand where i'm coming from and appear to be coming from the same place as I, a sceptic of anything our 'unelected coup' puts out for public consuption. This is awesome news guys, I am so happy for him and his family. Trusting that things dont drastically change for the worse, I think this is a good indication that our legal system is ready to represent what us Canadians think in general about the American drug war, as opposed to what the American government thinks about it. I agree with FoM, this is possibly the most intense thread I have read on the site. I just hope that everyones passion for the subject(s) at hand can be put to a productive use, not harmful. I also think we should all make our support of the courts' decisions of late known as vocally as we feel comfortable. Encouragement at this point could make a big difference. =)

Human Rights Impact....
When I read a piece like this recognizing that civilized governments consider people serving sentences based on the type of thing Kubby for which supposedly belongs in the nick to be "refugees", I become a very ashamed American. I don't often feel that way about this country -- despite all its ills -- because there are so many good things about the U.S. The last time I felt this ashamed of my own country was decades ago in the 1970's when even mainstream conservatives like my now 73 old mother decided she would send her three sons to Canada before she would let us be drafted. When more middle class people start to see the WoSD this way, perhaps because they must undertake a second mortgage to pay the college tuition of their kid who got the "MJ ticket" years ago, the free mileage politicians get out of being "tough on drugs" will be mileage in REVERSE! Viva siempre los idiotaes tal como Mark Souder!

The US has killed hundreds of thousands of innocents and run roughshod over the soverign rights of other countries for decades, 9/11 is no surprise and was way overdue.

I am sorry, but with gross overpopulation of the planet, 3000 people is just about nothing. People as individuals may have some meaning (good or bad), but as raw numbers or "the masses" they are pretty much worthless and/or detrimental to the planet.

This crap about reimbursing the survivors and the families of the victims really pisses me off, too. Why the hell should taxpayers give them jack shit? Bet all those rich folks had great policies. They should get the exact same benefits as people subject to any regular disaster.

Say, whatever happened with the Kubby appeal legal issue? Did they appeal the judge's claim that he had no right to fight the prosecutor's appeal of his mushroom conviction reduction from a felony to a misdemeanor???

With regards to the above article: the Good Guys finally won one!

As for the rancor that been expressed here: look folks, information (as we all know far too well) can be slanted by those with ulterior motives to do so. We experience this every day. (The vast majority of the articles posted here are written by antis. All you usually have to do on reaching the home page is just look at the number of responses to any given article to determine if feathers have been ruffled.)

I trust that the people who read here every day have come here precisely because they are fed up with predigested media pap and come looking for raw, uncensored data...in all it's flavors. Some of them can be awfully bitter. So I also trust that those who come here have fully-functional BS detectors engaged.

Information is not purely the domain of the angels; sometimes some very unsavory people can have a tiny shred of the puzzle. A vital shred. So I'll read what they have to say - with BS detector engaged with the squelch off to hear the first squawk of nonsense - and judge it based upon my own experiences. As, I suspect, do we all.

But I've spent too many years of my life being ordered about by people who didn't know what the bloody flippin' Hell they were doing...and they based their idiocy on somebody elses' ideology...which didn't brook questioning as to means and motives. Lest it be discovered as a self-serving pyramid scheme of some sort designed to both sucker you and cheat you. So, to avoid the usual traps, I'll read almost anything from anywhere...even US government websites.

How else can we determine the truth in any situation? Posting a link to a site that may or may not be 'legit' in the eyes of the reader is just one more proof that those here cannot be easily hoodwinked, and that their desire for facts will lead them to strange places.

(The truth behind the forces and personages behind the US prohibition of cannabis alone is indeed stanger than any speculative or science fiction story could ever be...yet the facts are inarguable.)

To try to close off a source by attempting to de-legitimize it based upon a public denunciation of the origin is the same kind of game antis play. I prefer to let the readers decide...

I am glad that you respect Canadians, guess I am sorry I don’t respect Americans, Israelies or Canadians, I think they may well be the bane of the planet, I respect individuals, like FoM. All my life we have been under the threat of the American war/drug machine, we have witnessed it in action in over a hundred countries in just my short life span, now with the help of the internet we can dispel some of the ignorance about what is really happening. This whole war on terrorism is the same as the war on drugs, it is all bull, and it will only stop when the people of the countries STOP paying the governments to do it, when they quit peeing in bottles or bending over to be searched and stand up, regardless of repercussions. I am not name calling, however a put down is certainly in order, the country that claims to the world, to be so free, is now a first class “police state” complete with their own Gestapo, named “Office of Homeland Security”. Still, with all this going on they think to dictate to the world how to be free.

I've been pretty quiet here of late. I had felt that some of my comments on the economic/human rights debate, especially a dialogue with E_J, (E_J, I loved your comments on Fred Hampton) had created a diversion from the issue at hand.

The last thing I had intended.

And besides, most of my viewpoints have been well represented in my absence. Someone even included a founding fathers quote...

But, I thought I could help smooth some feathers here. I hope so anyway. While I am not an observant Jew, I grew up in NYC, Jewish with a very Jewish name. This became apparent to me recently travelling to the Islamic Republics of Tajilistan and Afghanistan on an American passport. Sometimes it matters not how you define yourself, but rather, how others define you.

Anyway, 9/11 was a shocking event, moreso now, as we begin to get news in the mainstream media about foreknowledge by, at the very least, agents in the FBI, who did their utmost to warn higher ups.

The alternitive press and internet have raised even more shocking allegations. Evaluating the differing allegations is a duanting tast. I have my thoughts, none of which reach 100% certainty, but,

I would recommend Greg Palast's work to anyone. His track record is exemplary. He was talking about Enron two years ago, and he was the first to, my knowledge at least, say that Hugo Chavez of Venezuela had not resigned.

In our search for truth about 9/11, let us not forget the common bond that links us. For me, this is a search for a common justice that applies to all, that is just in the first place.

For myself, 9/11 aside, I cannot condone Isreal's recent actions in the West Bank and Gaza, and the settlements are a continuing obstacle to peace, but, I think the record will show, *eventually, that there were warnings from Israeli intelligence prior to the event.

Please don't think we're a bunch of bigots. Some might label me anti-semitic because I'm a Christian, but I don't think that's your view of me.

If the Israeli gov't does something wrong we don't blame the Jewish people. We're used to our gov't lying to us, so we really don't trust them, and I pray the rest of the world doesn't hate me because of those in power.

This is the first time I've ever heard cries of racism in this e-group. I understand why you might be defensive, as I am, about people unjustly hating us, but to ignore the fact that power corrupts some, even Jewish people, could leave you open to a lot of pain.

I finally read the articles. I see why it could be upsetting. I don't know what is true or not. I don't think it is but that's as far as I will commit saying.

Truth is what we want. A couple times I haven't posted an article on C News because I knew it was so wrong that I didn't bother. I post anti articles but I consider that truth from their point of view not mine. I don't know but I will pay attention and see if this surfaces with details that will make sense to me. I don't understand it very well. I have trouble understanding some news articles. They often go right over the top of my head.

Hi Everyone,

This thread has been one of the most different yet powerful threads I've seen. I'm not sure why this particular press release set this off but it did. I sense such anger and frustration in some of the comments and that's not being judgmental just observant. I can't speak for others but I can speak for myself.

We are a community of people with different religious backgrounds, different ages, different sexes and sexual preferences. We have a common denominator. We want the laws changed on Cannabis. That is our unifying issue. I know I don't have the answers to the worlds problems and probably never will but that won't stop me from trying to find the answers. I hope everyone thinks when they speak. Once angry words are spoken they can't be taken back. People don't forget what people type on a computer and they read it. We are adults and we can achieve peace in the drug war if we don't destroy ourselves with issues that really are way out of our reach and also remember that having the Internet is what has brought us together and we learn from using it. We can't let it be the thing that tears us apart or then what is the Internet but a big money maker for big companies. Just my 2 cents.

You (Nueva Mexican) posted a link to an article that was deliberately published in the Arab media as a propaganda tool to foment hate against Jews and Israel. To take this out of context and spin this into Cannabis activism is exploitative and hurtful to those who experienced the World Trade Center disaster firsthand. I watched the Towers burn and fall. I lost business colleagues and friends. One of the firefighters who lost his life was a strong supporter of the cannabis legalization movement in NYC. Many of us in NYC still deeply mourn his loss. I do not need a lecture about the injustice of the DEA against medical marijuana patients and lack of freedom in the US, I am well aware of what is going on.

I don't mind if people share how they see a particular issue. I don't put my beliefs in conspiracies. I never have and really don't understand them but I do know that a puzzle needs all the pieces to be complete. That's why I understand different views from different people on different topics. I could pick a side on what is happening in the Middle East but I won't. A friend that we hadn't seen for a long time dropped by right after 9-11 when we all were talking about it and I asked him what did he think about the WTC disaster. He looked me straight in the eye and said I wondered why it took so long. He said he wasn't shocked at all. We intervened in their war and now we are in the way. This is a war between two religions and we are right in the middle.

If anyone has followed the Kubby's case over the last few years you will know that they have the will and the heart to make a difference. I don't know them personally but I am aware of their determination. Having those qualities can change the world.

I watched The Preakness yesterday ( I love horses ) and watched War Emblem win. He is a mean natured horse but he has heart! Having the will and heart can do wonders. The Kubby's have the will and the heart and history will record it as so.

Nuevo Mexican the satellite should be installed this week! I can't wait! I can't wait! I can't wait! LOL!
