  California Men Face Hearing in Canada

medical Canadian police have arrested two medical marijuana activists who had fled north to avoid drug charges in California, alleging they had violated Canadian immigration law.

Humboldt County pot grower Steve Tuck and Steve Kubby, 1998 Libertarian Party California gubernatorial candidate, are in custody after being arrested Tuesday at their homes in British Columbia.

They face hearings today to determine whether they should be allowed to stay in Canada, said a spokesman for Canada's immigration service.

Both men have previously said they would seek political refugee status in Canada if the United States asked for their extradition, or if Canada attempted to deport them.

Alex Stojicevic, a Canadian immigration attorney representing both men, said Canadian officials have decided Kubby and Tuck are "inadmissable to Canada" because of their legal troubles in the United States.

Tuck, 35, faces six felony pot charges in Humboldt County. He fled to Canada in July.

Kubby, 56, who moved to Canada in March with his family, is battling peyote possession charges stemming from a 1999 raid at his Placer County home. He also faces probation violation charges.

Attorney General Bill Lockyer is appealing a Placer County judge's decision to reduce the peyote conviction from a felony to a misdemeanor.

A California appellate court ruled last week that unless Kubby returned to California within 30 days, he would lose his right to argue against Lockyer's appeal.

Stojicevic said he'll ask for the men to be released from custody today and will try to postpone the deportation hearings. He said in Kubby's case, he will argue the peyote charges wouldn't be considered a criminal offense in Canada, and shouldn't warrant deportation.

Tuck's case, he said, "is more complicated," because he's charged with crimes that would warrant punishment in Canada.

Kubby was a fund-raiser for California's 1996 Proposition 215, which legalized medical pot use with a doctor's approval. From British Columbia, he has been a vocal opponent of the U.S. war on drugs.

Note: Suspects being sought by U.S. officials in drug cases may be deported.

The Punic Wars
I have often wondered if the word punish comes from the Punic Wars. The word Punic comes from punicus, Latin for Phoenician. The first Punic War broke out in 264 BC and ended in 261 BC with Rome settling the peace by taking Sicily and Sardinia and Corsica from Carthage. In 218 BC Hannibal began the Second Punic War. Hannibal returned to Carthage after 15 years in Italy and was defeated at Zama about 20 miles outside of Cartage and that broke the power of Carthage forever with the big indemnity and the concession of Spain to Rome.

And what happenned to Hannibal when he was forced to flee to the land of the Seleucids over towards Lebanon and Isreal area today? He stirred up anti-Roman sentiment about like Kubby and Tuck in their exile. And the Romans had to have his head and in 182 BC he committed suicide to prevent his capture. Now how amazing is it that we still have Hannibal's suicide statement?: Let us relieve the Romans of their anziety: they are too impatient to wait for an old man to die." Does that sound familiar?

It was the extremist on the Roman side that demanded the Third Punic War saying - Carthago delenda est- "Carthage must be destroyed." It took three years but Carthage became a Roman province. This was Roman Venom at work because it could not tolerate the prosperity of Carthage.

Does anyone see why I wonder if the word punish comes from Punic. And are they treating Kubby and Tuck like Rome treated Hannibal? As the old Roman saying goes "There is nothing new under the sun."

By the way the national epic of Rome is the Aeneid written by Virgil. Virgil also wrote the Art of Poetry which led to what would be my pen name if I really used it -Virgil Art P4me.

The Republican Venom used in going after these sick men in their land of exile shows what current venom is like. It is also a terrible waste of money.

A medical marijuana activist and former California gubernatorial candidate wanted in Placer County for failing to serve jail time has been arrested, Royal Canadian Mounted police officials said.

Steve Kubby, 55, a 1998 Libertarian candidate for governor and a force behind the passage of a California proposition that legalized pot clubs, has been living in Canada in violation of a court-ordered 120-day jail stay. He was arrested Tuesday.

Kubby was convicted of two misdemeanor drug-possession counts in December 2000, but failed to surrender to the Placer County jail as ordered on July 25, 2001.

He has said that a 120-day incarceration without access to marijuana therapy would be a death sentence. Kubby suffers from adrenal cancer, and claims pot has preserved his life for more than 15 years.

Although Kubby and his wife, Michele, prevailed on the more serious marijuana cultivation and sales allegations, he was found guilty of possessing small amounts of two illegal substances found in his Olympic Valley house.

In a telephone interview with The Sacramento Bee on Wednesday, Michele Kubby said her husband's immigration lawyer in Canada was attempting to secure his release on bail.

Recently, the 3rd District Court of Appeal in Sacramento ruled that Kubby's appeal would be dismissed unless he surrenders to Placer County officials within 30 days.

The appellate court ruled that, as a fugitive from justice, Kubby "has forfeited his right to appeal his jail term."
