  San Francisco Trio to Get Utah Trial on Pot Charge

medical Three medical marijuana advocates, including one who wrote the successful proposition in California to legalize medical marijuana use, will face a jury trial on charges of possessing more than a pound of the drug police allegedly found in a Cedar City motel room last fall.

During a preliminary hearing Wednesday, 5th District Judge Robert Braithwaite warned the trio about trying to use California's controversial law as a defense: "Whatever the laws are in another state or what another state does is irrelevant here."

Dennis Peron, 55, who wrote the successful proposition in California, pleaded innocent to charges of possessing marijuana with intent to distribute, a third-degree felony, and possession of drug paraphernalia, a class B misdemeanor. John Entwistle, 38, and Kasey Conder, 19, who were with Peron on Nov. 14, also pleaded innocent to the same charges. All three San Francisco residents remain free on bail.

The three men had rented two rooms at a Motel 6 on their way to go camping at Zion National Park south of Cedar City in southern Utah. A motel clerk called police when she became suspicious of an odor coming from the two rooms the men had rented.

Officer J.R. Robinson testified that when officers first knocked on the door of the motel room, Officer Kandice Adams identified herself as a member of the motel's maid service to get the occupants to open the door.

Once in the room, Robinson testified the uniformed officers could not see any marijuana but could smell it.

After a drug-sniffing police dog indicated the presence of the marijuana in the room, Robinson said it provided probable cause for a search. Police allegedly found more than a pound of marijuana and $7,400 cash. Another bag of pot was found in one of two cars belonging to the group.

Iron County Drug Task Force Officer David McIntyre testified the marijuana was probably going to be sold because of the large quantity.

When asked if he knew about the medicinal use of the drug, McIntyre said he had heard of people using marijuana for medical reasons but that it was not legal in Utah.

"I don't think you smoke medicine," he said.

Despite being bound over for trial, Peron said he was pleased with Wednesday's hearing because the controversial issue was raised.

Despite the judge's warning about invoking medical use of the drug in their defense at the trial, Peron said he plans to submit his medical records at the trial. He also said the doctor who prescribed marijuana as a treatment for his alcoholism will testify.

Another thrust of his defense will be that police violated his Fourth Amendment rights against unwarranted search and seizure by entering the motel room without probable cause.

Outside the courtroom Wednesday, Peron pointed to a section of the Utah statute he is being charged under which exempts people from being prosecuted for possession of a controlled substance if they have a valid prescription.

Iron County Deputy Attorney Paul Bittmenn, who is prosecuting all three cases, said the law pertains to prescription drugs and not marijuana.

But Peron stays undeterred. "I can say we're going to win."

..if there were some way of having a national commercial,,,that was just like that ghastly ondcp outrage,,with all the kids saying shit like ;"I bought a bomb",,"I paid for a guy to kill a homeless policeman".."I helped pay for bin ladens video",,"I chipped in on the bullet that killed your mom"................................but instead,,ya got the kids saying stuff like;;;"I killed an innocent mom and two of her children in Afghanistan"....."I bought a new Mercedes for my congressman"...."I put my dad in prison"..."I gave 50 thousand dollars to the infant child of a stock broker who died in the world trade center tragedy,,,,,I gave his wife 800 thousand"....

...how bout showing some weird ,,oily guy,,books in hand,,,on the campus of a university,,,, ...the announcer,,James Earl Jones says;"this convicted rapist,and suspected murderer has almost finished law school. You paid for his education thru federal grants.",,then we show some kinda white afro -oriental Mexican guy,,,, ,, ,,,,and the narrator says..;'"this straight A student will not be able to recieve any Federal aid....He was caught with some Marijuana.",,,,Then we show the oily rapist creep walkin' up to some spacey,innocent lookin' young chick on campus,,and flash to the young straight A student ,who is flippin' burgers and sweeping parking lots.... ...and then,,,they show the convicted rapist guy starting to deev out on the chick at the dorm,,,and we zero inb on his face,,and he says,,,"thanks"........

...I dont know,,,,drug trial in Utah,,,,Atticus Finch,,Johnny Cochran,,and Barry Schneck couldnt help these guys. ..I think Utah is kinda spooky........I hope that this will be a lesson to those who dont want to get busted!...for goodness sake,,,if ya gotta smoke some weed in a hotel room,,dont fire up a big ol' reefer,,sneak a toke off a pipe in the bathroom,,preferably while taking a shit.........And avoid smoking weed when you are from out of state,and have a bunch of weed with you......I hate to say it,,but it's not that hard to avoid getting busted....A prudent Marijuana user can remain free ....just remember that most people dont understand..If pot is smelled,,cops get called...........If ya wanna get stoned in Utah,,or anywhere else,,,pretend that you're Bob Downey Jr.,,or Daryl Strawberry,,and dont get caught!....Pretend you are a secret agent or something ,,and realize that it is no small matter when the bad guy catches you!...think of the cops as Goldfinger,,or Wo Fat..........imagine getting busted by John Bunnell and being humiliated on national TV ,,,,Americas most Wanted....YOU,,in handcuffs,,and the narrator sez,,"This druggie thought he could get stoned out of his mind in the hotel room,,but thanks to the watchful mormon hotel clerk,and his keen sense of smell,,the Utah cops were able to stop these fools from freaking out on pot,,and peddling their wares to the children of Salt Lake City!...The only stone these doped up druggies will see,will be the stone of jailhouse walls..."..
...OK,,,,,,finally....here's my idea for a pro-Marijuana legalization TV commercial;...It would be a slickly produced thing,kinda like the ondcp,or navy has done recently,,,and it would show a bunch of guys getting busted with small amounts of weed,,,a couple of SWAT team,door bustin' home invasion intrusions,,with terrified children being ordered to lay face down on the floor,as mom gets hauled out to the cop car,,and dad is threatened with losing his house and his kids unless he tells the swat gestapo where the stash is,and all about how things will go easier for him if he turns in a friend......then the deep voice of 4Q would come on and say;"Dont let this happen to you.If you want to smoke pot,dont get caught!,,getting busted will destroy your life.......Enjoy Marijuana,but remember that it is considered to be the same as heroin by the police state that we now live in."....etc....yada yada yada...dddd

be careful
A motel clerk called police when she became suspicious of an odor coming from the two rooms the men had rented.

Always use the bathroom fan. If there's no fan then run cold water thru the shower head full blast, as in a baptism for the dead.

Vote them out of office. Educate your parents, hold your ground, give them the facts. Give your boss the ultimatum. Be firm, be kind, be honest. Be seen and heard in the street on 4/20. Stay out of jail.

Dennis and friends deserve to be free
I hope Dennis is right and that they are going to win. They are non-criminals and Dennis has a long history of being a great humanitarian and voice for social justice. It is sickening to think that a violent person or pedophile priest could be released to make room for this great person who is no threat to anyone. Hopefully, they will receive widespread support and beat these charges, even in such a Taliban-influenced area full of religious conservatives. It is time for all such madness to finally end

With a jury filled with white Mormans the deck is already stacked against them. But Peron stays undeterred. "I can say we're going to win."
