medical Four men arrested in a Bay Area marijuana sweep last month have been indicted on additional charges by a federal grand jury in San Francisco.

Three of the defendants -- Kenneth Hayes of Petaluma, Richard Watts of San Francisco and Edward Rosenthal of Oakland -- are allegedly associated with the Harm Reduction Center, a medical marijuana club in San Francisco. They were indicted Thursday on a new charge of conspiring to cultivate more than 1,000 marijuana plants in addition to counts of marijuana cultivation.

The fourth defendant, James Halloran of Oakland, was charged in a separate indictment with cultivating more than 1,000 plants, growing marijuana within 1,000 feet of a playground and maintaining premises at East 12th Street in Oakland for the purpose of growing marijuana.

All four were arrested on Feb. 12. Hayes was arrested in Canada and the others were apprehended in the Bay Area. The indictments replace criminal complaints issued on Feb. 12 that charged each man with growing marijuana and maintaining premises for the purpose of marijuana cultivation.

Rosenthal and Halloran are scheduled to be arraigned by a federal magistrate in San Francisco on Monday and Watts is to be arraigned on Tuesday. Hayes is still in Canada, according to the U.S. Attorney's Office.

Hayes, 34, was tried and acquitted last year in Sonoma County Superior Court on state law charges of marijuana cultivation and sales. He is described in an affidavit filed last month by a U.S. Drug Enforcement Administration agent as the operator of the Harm Reduction Center and the head of an organization that allegedly cultivates and distributes "large amounts of domestically grown marijuana.''

In addition to the conspiracy count, Hayes is accused in the indictment of growing more than 100 marijuana plants in Petaluma, cultivating more than 1,000 plants in San Francisco and maintaining premises at 52 Sixth St. in San Francisco -- the site of the Harm Reduction Center -- for the purpose of cultivating marijuana.

Rosenthal, 57, the author of several books on marijuana cultivation and a columnist for the magazine Cannabis Culture, is described in the affidavit as a marijuana cultivator who produces marijuana for Hayes. The indictment charges him with maintaining premises at a former warehouse on Mandela Parkway in Oakland for the purpose of marijuana cultivation, growing more than 100 plants and conspiring with the other defendants to grow more than 1,000 plants.

Watts is described in the affidavit as a Harm Reduction Center employee who allegedly distributes marijuana for Hayes. He is charged with conspiring to grow more than 1,000 plants, growing more than 1,000 plants and maintaining the premises at 52 Sixth Street for the purpose of cultivating marijuana.

Court TV does not cover federal criminal trials as federal courts generally do not allow cameras, esp. in criminal cases. But, even if the court allowed it, I doubt a major media outlet would have the interest. I don't recall ever seeing a drug case on Court TV even from a state court.

Hell, though, even the NY Times or Washington Post aren't covering this story much. That, plus the media ignoring Scotland's "treasonous" abondonment of the WoSD, plus the media's receipt of millions and probably billions of ad dollars from the ONDCP and producers of legal drugs, is what is so f**ing depressing.

I appreciate your post. The more I defend this plant, the more I seem to get out of it. Understanding it's references in the Bible and other religious books, is very important. Because it's gonna take an act of God to rescue it from the evil grip of the DEAth squad. God made it, and we will use it and give thanks for the opportunity. Fact is, Edward Rosenthal is joined by many. Together, with Christ God, Truth, WILL win. One thing seems relevant: not only did God give us cannabis but it is written on the very 1st page of the Bible (and remember Gen. 1:11-12 along with 1:29-30).

With all that is said in the Bible, the plants were not put off and then they were put in the same company as the heavens, the earth, light, stars, living creatures and man himself (good company). The Bible may not be the very beginning of time, but it was the beginning of something, like the beginning of another chance, and in putting this plant info up front it seems that we are indicated this all occurred before and it all came down to plants. Notice also that one the 1st page when it speaks about plants, unlike the other creation, that the plants were more descriptive, in that it says they are; good, every and very good. Notice that all these very good green seed bearing plants were not given to prohibitionist, but rather they were given to every beast of the earth and to every bird of the sky and to every thing that moves on the earth which has life, “I have given every green plant for food”... Also notice that in Gen 1:29 the same word is used that is used in that 1 Timothy 4:1-5 verse, so that whatever the version of Bible you see, they will match, so in my New American Standard Bible, food is used in both verses, where meat is used in the King James. Notice that in the N.A.S.B. that there are titles and headings and in 1 Timothy 4:1-5, the title is The Apostasy, and in 2 Th. 2, it speaks of the apostasy, and tells us what is happening today. It tells us WHO, HOW, WHY AND WHEN. Notice in Titus 3:9-11, it indicates, what just got said in 2 Th.2 & 1 Tim. 4, that THEY are the SELF CONDEMNED.

The Bible is written in green, it speaks of plants from the very 1st page to the very last page.

Biblical implications are perhaps what the evil powers are afraid (the most) for the masses to know. I understand some of the Biblical / spiritual relationship of cannabis and it makes me think, I really haven’t BEGUN to understand ALL that there is in relation to Biblical use of cannabis. With all that we know about cannabis, it seems in reality, we may presently know very little, compared to what there is to come.

What if, of all the fuels, cannabis is the only one that would get someone to Neptune. With out even leaving the planet. If you can make potato batteries, what about brains, that react as such, for ... the brain is a power source. (POWER OF FEW MINDS ? freedom fighter) It is interesting that the triangle is the sign for earth, and pyramids, it is at the top of the pyramid on a dollar bill. It is also part of the sign in THC’s name. Could they have made pyramids with out cannabis? We are upgrading the Hubble? Do you suppose THEY are looking for other pyrimids?

When you understand the Truth written on the 1st page of the Bible, you do not stumble from the very 1st page.

The relationship with the promised Holy Spirit of Truth is like a computer with out wires.

People have to be prepared to react en masse
This trial could just as well be some secret tribunal if nobody but the Chronicle and Examiner cover it. But that could very well happen. That's already what's happening.

People will have to be preapared to turn the Internet over to that topic of discussion everywhere possible should there be a trial.

Turning point?
For years people have been waiting and waiting for a turning point. Maybe we have one here. The Oakland case was a sham, but the Supreme Court did slightly leave the door open. There are two ways i think that the Supreme Court would overturn current philosophy. First is, States rights..the constitution does not decribe any crimes in it's wording, EXCEPT for treason since it is a crime against the state itself. Someone MAY be able to convince them that since the state has regulated itself, the government cannot intervene. Secondly, Religion...this is the one that i could see having a bigger chance. Unlike states rights, religion, and the practice thereof, is expressly protected by the bill of rights. I cant speak for anyone else, but when I look at passages from the bible, and the strong religious background of this country, i think that the Surpeme Court would be hard pressed to uphold any convictions that were made by people who use cannabis as a form of ceremony or religious practice. And even better, our proof of our religion is pulled straight from the book they hold up when they are defending their laws. "It is the word of God himself" God made cannabis..but NOT weed or marijuana..those are American terms for God's gift to us, and they are used in a strictly negative sense and we should stop using them. Our plant is rightfully called cannabis and that is what we should call it. Either way, you KNOW Ed will not go down without a fight and he will use any method necessary. I know that he must be extremely unhappy with the events surrounding him, but perhaps he could be the man who legalizes Cannabis in america for the first time since the 30s?

Change is coming Amerikkka, whether you like it or not. Your own children do not believe you anymore and are finding their own way. It is not a way you accept so you try to punish us, but we will not go away. We still know the difference between right and wrong, unlike you it seems. One day, you will pass, and it will be our turn to make the rules. You probably wont like them, but you'll get used to them..You wont have a choice.

Blind Hope?
For some reason...I can't help but feel that something good is going to come from this, regardless of the outcome of the trial. I can't put my finger on what it is, but I definitely think this will do more than just open a lot of sleepy eyes. Ed is an honorable man...being prosecuted by people who really don't know & don't care about honor & who have to place the adjective "compassionate" in front of the word "conservative" to fool some gullible folks into thinking that these particular so-called conservatives have some idea what compassion really is. This country has suddenly turned into the armpit of the universe but I still love what it is supposed to stand for & I will oppose anyone who tramples on the rights & freedoms granted to me by it's creators. God help this country.

Be like Epaphroditus.
Epaphroditus is only mentioned in Philippians. Kaneh bosm is known before the King James Version as among other things, sweet smelling incense. Read all of Philippians and it seems we have a Biblical example of someone delivering cannabis.

Philippians 4:18; titled: God's Provisions. But I have received everything in full and have an abundance; I am amply supplied, having received from Epaphroditus what you have sent, a fragrant aroma, an acceptable sacrifice, well-pleasing to God.

Can Ed Beat The Rap?
This will be quite interesting, indeed. Here we have a veteran courtroom witness, who has no fear of prosecutors, or judges. The main problem of course, is the Feds will not allow the defendants to even say the word "medical". Now, with that known, how can they get acquitted? The only way I can think of is by jury nullification. That being where the jury finds a defendant innocent because the law itself is unjust, or is unjust in a particular application, and so should not be applied. (see link below) If this happens in Ed's case, we will see a lot more pressure to allow states' rights be upheld, and less intrusion by our government in similar cases. In fact, several congressmen are trying to pass a bill that would do just this. If passed, each state that has its own medical marijuana law would no longer be threatened by the government to override such law. A good example of this would be prostitution. Only in the state of Nevada is prostitution legal. The state of Nevada has voted to allow it, and regulate the brothels. Medical marijuana will soon be similar to that law. Each state will either allow its use, or prohibit its use. That is the best way to clear up the conflict between states' rights, and too much governmental intervention.
