The Emmy-winning actor of TV's "Ally McBeal" most likely would have gone to prison but for Prop. 36, the voter-approved measure that calls for treatment for nonviolent drug offenders, prosecutors said. Downey became the 25th offender sentenced under Prop. 36 in Riverside County since the measure took effect July 1, said Deputy District Attorney Tamara Capone.
